The subject matter of the contract is:Delivery of medical devices for invasive neurosurgical proceduresSection 1 - Task 7 Disposable equipment for the treatment of intracranial aneurysms, arteriovenous malformations and meningeal fistulasThe Orderer allows submitting partial offers.The parts of the contract are the individual tasks specified above, i.e. tasks from 1 to 7.The Orderer informs that the Economic Operator may submit an offer for a maximum of 7 tasks (without limiting the number of tasks per one Economic Operator).A detailed description of the subject matter of the contract is included in Annex 2b to the SWZ.
The Ordering Party's requirements regarding the subject matter of the contract: 1) The offered medical device must have approvals, certificates and be registered in accordance with the law requiring the possession of approvals, certificates and registration,2) The offered medical device must be marketed and used in accordance with the requirements of the Act of 20 May 2010 on medical devices (Journal of Laws of 2020, If the offered medical device does not require notification to the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products, the Contractor shall be obliged to perform at his own expense and within his own scope all activities necessary to meet all legal requirements related to marketing and use of the product in the territory of the Republic of Poland. In case of any doubts, the Ordering Party reserves the right to call upon Economic Operators to submit samples of the offered product in order to verify its compliance with the descriptions included in the SWZ. Failure to submit the required samples or submission of samples that do not meet the requirements specified in the SWZ will result in rejection of the bid pursuant to art.226 item 1 point 5 of the PPL Act.3.4 In cases when the description of the subject matter of the contract indicates trademarks, patents or origin, source or specific process that characterizes specific products or services provided by a particular contractor, it means that the Contracting Authority cannot describe the subject matter of the contract in a sufficiently precise and understandable way, however in each such situation the Contracting Authority shall allow solutions that are equivalent to those described above. In such situations any reference to trademarks, patents, origin, source or a specific process that characterizes specific products or services provided by a particular economic operator should be read together with the words "or equivalent".When describing the subject matter of a contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3), the Contracting Authority shall accept solutions equivalent to those described. 214(1)(7) AND (8), JOINT SECTORS The Contracting Authority does not anticipate awarding any contracts as referred to in art. 214 par. 1 item 7 of the PPL Act.The Contracting Authority does not foresee awarding any contracts referred to in Article 214 par. 1 item 8 of the PPL Act.DESCRIPTION OF CRITERIA WHICH THE CONTRACTING AUTHORITY WILL TAKE INTO ACCOUNT WHEN SELECTING A TENDER'S TENDER, INCLUDING THE WEIGHT OF THESE CRITERIA AND THE METHOD OF EVALUATING TENDERS13.1.
