Description

1)The subject matter of the order is the sale together with the delivery of "standard" diesel oil to the Ordering Party. (ON) intended for refuelling the Ordering Party's vehicles and combustion equipment, meeting the requirements of the PN-EN590+A1:2017-06 standard and the requirements of the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (i.e. Journal of Laws of 2015, item 1680).The technical and chemical parameters of the delivered diesel oil may not be worse than those specified in the aforementioned standard and in Annex 3 to the Regulation. The scope of the subject matter of the contract includes the sale of 33000000 litres (estimated value) of diesel oil together with its successive delivery to the Ordering Party.The amount of diesel fuel (33000000 liters) specified by the Purchaser is an estimate and therefore may change ±10% depending on the Purchaser's current needs. The Contractor shall have no claims for failure to deliver the estimate of diesel fuel by the Contractor.2) Place of order completion: a) ground tank with a capacity of 5000 litres, equipped with a dosing device, located in the Waste Management Plant in Zakurzewo near Grudziądz, b) ground tank with a capacity of 5000 litres, equipped with a dosing device, located in the Water Treatment Station in Grudziądz, at Hallera79.3) Requirements for the way of order completion: - Delivery ON will be carried out by the Contractor's transport.Delivery of ON will take place by road tankers at the disposal of the Contractor, meeting the requirements specified in the Act of 19 August 2011 on the Transport of Dangerous Goods (i.e. Journal of Laws of 2009, item 382). with changes) equipped with legalised equipment for measuring the amount of fuel discharged to the Ordering Party's tank [at each unit delivery the Contractor must provide a certified copy or original of the current certificate of road tanker flow meter legalization] - Delivery shall be made in instalments, at the cost and risk of the Contractor, according to the current needs of the Ordering Party (4-7 times a month) in the estimated average quantity of 4500 litres at one time, on the basis of a unit order submitted to the Contractor electronically.The Contractor shall make a unit delivery within 24 hours from the day of receiving the order, however, the Contractor shall each time confirm the acceptance of the order. Orders and deliveries shall be placed on working days - i.e. from Monday to Friday from 7.00 a.m. to 2.00 p.m., excluding public holidays.For each of the one-time deliveries the Contractor shall be obliged to deliver the quality certificate of the manufacturer ON-atest should be connected with the proof of delivery or issue by placing on it the delivery or issue number, it should include: number, date of issue, name ON, name of the body issuing the quality certificate, date of acceptance ON and results of ON-testing.The Ordering Party reserves the right to make a random inspection of the delivered ON in terms of quality and compliance with the delivered quality certificate, by handing over the ON sample to an independent accredited laboratory for testing.- The Ordering Party will be considered as completed only when ON is pumped into the Ordering Party's tank and confirms the quantity of ON.-The document will be signed by an employee of the Ordering Party and a driver of a tank truck. The amount of accepted fuel entered and confirmed by the above-mentioned persons will be the basis for issuing a VAT invoice. Detailed fuel collection conditions, price and payment conditions are discussed in the model contract, which is attached as Appendix No. 4 to the ToR.The price offered must include all costs associated with the delivery, including the cost of transporting fuel.
