Description

(1) The subject matter of the contract is the recurring periodic non-cash purchase of liquid fuels (diesel fuel, diesel fuel with an increased cetane number, unleaded gasoline PB95 and PB98) for vehicles and equipment at the disposal of the Employer, carried out at gas stations in the form of fuel cards assigned to the vehicle/equipment. (The list of equipment is attached as Annex 1 to the ToR). - I part of the contract. 2 Successive delivery by the Contractor to the Ordering Party of diesel fuel, intended for the propulsion of compression ignition engines, The volume of delivery of diesel fuel is a total of 500,000 liters for 2 years. - II part of the contract.
(1) The subject matter of the contract is the recurring periodic non-cash purchase of liquid fuels (diesel fuel, diesel fuel with increased cetane number, unleaded gasoline PB95 and PB98) for vehicles and equipment at the disposal of the Employer, carried out at gas stations in the form of fuel cards assigned to the vehicle/equipment. (The list of equipment is attached as Annex 1 to the ToR). (2) Fuel purchases will be made successively as required by the Ordering Party. The Contractor shall have a minimum of one gas station where fuel required by the Ordering Party will be available. The gas station must be open 24 hours a day a minimum of 7 days a week. The station must be located within 6 km of the Employer's headquarters, i.e. Local 11, 43-100 Tychy.3 Settlement will be based on the actual refueling. The Employer requires the Contractor to issue a minimum of 5 maximum 1 invoice per month for the fuel actually refuelled. The minimum payment term of the invoice is 7 days from the date of delivery of the invoice to the Employer. The number of invoices issued will depend on the quantity proposed in the bid (bid form) - the number of invoices issued per month is a criterion for bid evaluation. Reports including information on the number of liters refuelled, the type of fuel refuelled, the vehicle registration number and the meter status at refueling will be provided to the Employer with each invoice.4. A fuel card will be issued for each vehicle (according to the registration number). In addition, the Contractor will also issue cards for the persons who will refuel each vehicle (after providing the required data: vehicle number, meter status).5. Standards that fuels must meet: a) Regulation of the Minister of Economy of October 9, 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680). b) Regulation of the Minister of Economy of March 25, 2010 on methods for testing the quality of liquid fuels (i.e. Journal of Laws of 2017, item 247). c) PN-EN 590+A1:2017-06 Motor vehicle fuels - diesel fuels - requirements and test methods. d) PN-EN 228+A1:2017-06 standard Fuels for motor vehicles - unleaded gasoline - requirements and test methods. Each vehicle will be issued a fuel card (according to the registration number). In addition, the Contractor will also issue cards per person, with which each vehicle can be refueled (after providing the required data: vehicle number, odometer status)The Contractor will also issue 10 spare fuel cards for the company. The validity period of the fuel cards must cover the period for which the contract will be executed. The fuel cards issued will be for fueling only. - Diesel oil in accordance with current standards: 600,000 liters/2 years- Diesel with increased cetane number: compliant with applicable standards: 15,000 liters/2 years- Unleaded gasoline PB 95 compliant with applicable standards: 12,500 liters/2 years- Unleaded gasoline PB 98 compliant with applicable standards: 7,500 liters/2 years The subject of the contract is the Contractor's successive supply to the Ordering Party of diesel fuel, intended for the propulsion of compression-ignition engines, 1. The volume of diesel fuel supply is a total of 500,000 liters for 2 years. (2) In the event of changes in the law or standards, diesel fuel should meet the requirements specified in the regulations and standards in force at the date of delivery.3. The place of delivery of diesel fuel is: a non-pressurized fuel tank with a capacity of 5 m3, located in Tychy at 11 Lokalna Street, having the legally required features and legalizations. When unloading diesel fuel, the tank requires the use of a pump at the tanker truck. A single delivery to this tank should not exceed 5 m3. (4) The Contractor shall deliver diesel fuel to the place indicated by the entity, within 48 hours from the moment of placing an order by e-mail. Orders will be sent only on working days (Monday to Friday, excluding public holidays) until 12:00 p.m., and an order placed after 12:00 p.m. will be treated as an order placed on the next working day at 6:00 a.m. 5. The entity referred to in point 1 will specify the type of diesel fuel ordered each time in the order.6.. the Contractor shall be obliged to deliver the ordered diesel fuel, at his own expense and risk, only on working days from 6:00 a.m. to 2:00 p.m. 7. the Contractor shall deliver diesel fuel using means of transport-autocysterns. The loading and unloading boxes in the tanker trucks should be secured with seals intact. The tanker must be equipped with legalized dispensing equipment-pumps and printers-indicating the exact amount of diesel fuel dispensed at a reference temperature of +15 0 and at actual temperature. The tanker should be retrofitted with a special end with a faucet valve (so-called elephant), which will be placed between the tanker's drain valve and the drain hose for sampling. 8. the Contractor will be required to provide with the first delivery a current Material Safety Data Sheet / Preparation issued in accordance with applicable laws. 9. the Contractor shall be obliged for each delivery to fulfill all obligations, in particular notification obligations referred to in the Act of April 3, 2017 on the system of monitoring of road transport of goods (Journal of Laws of 2017, item 708). 10. the Contractor will be obliged to deliver to each delivery, before each unloading of the tanker truck, a set of necessary documents for the delivered ON, including at least: a) quality certificate (laboratory certificate), b) delivery instruction (pouring card). (11) The Purchaser reserves the right to carry out (before unloading the tanker) a preliminary inspection. 12) The Employer shall have the right, once during the quarter, at the expense of the Contractor to test the quality of delivered diesel fuel in an accredited laboratory of his choice. 13.Receipts of diesel fuel will be made on the basis of indications of the Ordering Party's control-measuring system in dm3.14.The amount of fuel given above is an estimate, the Ordering Party reserves the right to order less fuel, and in this case the Contractor will not be entitled to a claim in this regard.
