Italy - Diesel fuel

Description

The purpose of the contract is the supply of agricultural diesel fuel (lot 1) and automotive diesel fuel (lot 2) in the manner and under the conditions specified in the special tender specifications, in the tender rules, and in all other requirements, none excluded, set forth in the tender documents. The present contract has a three-year duration starting from the date of the stipulation of the contract, with the right, as described by the Consortium, to exercise the option to continue from year to year for another two years at the same conditions, as well as providing for the possibility that the supply may be extended for no more than a further year from the expiry of the contract, should this be necessary to complete the tender procedures for the subsequent assignment of the supply. The contract will become final only after the successful completion of an initial trial period of three months.
The objective of the contract is the supply of agricultural diesel to be delivered, as required, to the Consortium sites indicated in the special tender specifications and, in any case, to any water-scooping plant or operational centre of the Adige Po Consortium within the Consortium's area. The tenderer will have the appropriate permits to make deliveries even on holidays and days before holidays at the simple request of the Consortium in quantities requested from time to time, varying from 1,000 to 10,000 litres, within 24 hours of the order, in agreement with the Consortium personnel. The annual quantities of fuel shall be determined exclusively by the actual needs of the Consortium, without the Contractor being able to claim rights to minimum or maximum performance. The prices of agricultural diesel fuel, determined following the results of the tender, are inclusive of all charges, with the exclusion of VAT, to be borne by the successful tenderer for the delivery of the supplies to the place indicated for each delivery and the delivery itself, without the Consortium being asked for any additional compensation other than that explicitly indicated in the specifications and in the tender rules. The contract shall become definitive only after the positive passing of an initial trial period of three months. Within this period, if the Consortium, in its unquestionable judgement, is not satisfied with the performance of the service, it shall notify the successful bidder by PEC or fax, and the contract shall be considered automatically terminated without the successful bidder being able to claim anything except payment for the supplies regularly rendered. The diesel fuel must comply with the requirements of Legislative Decree no. 66 of 21.3.2005 as amended and Legislative Decree no. 55 of 31.3.2011 as amended. In any case, the quality of the gas oil must comply with the UNI EN 590 standards in force. If, during the course of the supply, the chemical-physical characteristics of the diesel fuel should change as a result of legal provisions, the appropriate product must in any case be supplied at the economic conditions indicated in the contract. Each delivery must be accompanied by all documents required by law and will be made free of charge to the site indicated by the Consortium. The simplified accompanying document (DAS) shall be duly completed in all its parts.
