Description
Delivery of antivirus software (#ANTYWIR) according to the Appendix "Part 01 OPZ" - 115 pieces in total. The Ordering Party requires a 60 month warranty period for the subject matter of the contract, counting from the date of final acceptance of the subject of the contract. If the manufacturer of a given component of the subject of the contract grants a warranty for this component for a period longer than 60 months, the warranty period indicated by the manufacturer shall apply. 3) The subject matter of the Agreement includes in particular: a. delivery to the Ordering Party's registered office of the aforementioned software packages at the Contractor's expense, to the premises indicated by the Ordering Party, b. providing the Ordering Party with a license to use the aforementioned software packages, c. providing the Ordering Party with subscription to the aforementioned software packages (at least for a period of 60 months).{#6#}8.3.3 [EDOC/EPK or ECOPDOC/EPK] certificate of the competent local organisational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or any other document confirming that the Economic Operator is not in arrears with the payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or any other document confirming that the Economic Operator entered into an agreement with the competent authority on the payment of such receivables together with interest or fines, if any, in particular obtained a legal exemption, deferral or division into instalments of overdue payments or suspension in full of the execution of the decision of the competent authority,8.3.4 [EDOC/EPK or ECOPDOC/EPK] excerpt from the relevant register or from the central register and information on economic activity, if separate provisions require entry in the register or register, in order to confirm the absence of grounds for exclusion pursuant to Article 24(5)(1) of the PPL Act,8.3.5 [EDOC/EPK] Contractor's declaration (in accordance with the specimen declaration in Appendix No. 8 to the ToR):a) failure to issue a final court judgment or a final administrative decision on arrears in the payment of taxes, fees or social security or health insurance contributions or, in the case of such a judgment or decision, documents confirming the payment of such dues with possible interest or fines or the conclusion of a binding agreement on the repayment of such dues, b) failure to rule against him as a preventive measure prohibiting competition for public contracts, c) failure to arrears in the payment of taxes and local fees referred to in the Act of 12 January 1991 on local taxes and fees,8.4 Within the scope of demonstrating that the offered solutions meet the requirements specified by the Contracting Authority: 8.4.1 [EDOC/EPK or ECOPDOC/EPK] description of the offered hardware and software referring to the requirements specified in the relevant part of Exhibit 1 to the ToR, enabling the Contracting Authority to verify that the offered hardware and/or software meets the minimum requirements, including at least: a) in the case of Parts 5, 6, 8 and 9 to provide data, which the Economic Operator is obliged to provide access to the relevant part of Exhibit 1 (for example, for the following reasons c) in the case of Parts 1 to 3 and 13, 14 and 15 the description of the offered software - this description may be in the form of information materials of the manufacturer in Polish or English,{-> #7#} Delivery of office software (#BIURO) in accordance with the Appendix "Part 02 OPZ" - a total of 120 pieces of the Ordering Party does not require a guarantee for the subject of the order. If the manufacturer of a given component of the subject of the contract grants a warranty for this component, the warranty period indicated by the manufacturer applies. The subject matter of the Agreement includes in particular: a. delivery of the aforementioned software packages to the Ordering Party's registered office at the expense of the Contractor, to the premises indicated by the Ordering Party, b. providing the Ordering Party with a license to use the aforementioned software packages,{#7#}8.5 If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland instead of the documents referred to in item II.2. 8.3 submits respectively:8.5.1 [EDOC/EPK or ECOPDOC/EPK] in section 8.5.1. 8.3.1 submits information from the relevant register or, in the absence of such register, another equivalent document issued by a competent judicial or administrative authority of the country in which the Economic Operator has its registered office or place of residence or place of residence of the person to whom the information or document refers, within the scope specified in art. 24 section 1 item 13), 14) and 21) of the PPL,8.5.2 [EDOC/EPK or ECOPDOC/EPK] item A. 8.3.2. - 8.3.4. submits a document or documents issued in the country where the Economic Operator has its registered office or place of residence, confirming respectively that: a) it is not in arrears with the payment of taxes, fees, social security or health insurance contributions, or that it has entered into an agreement with the competent authority on the repayment of such dues together with any interest or fines, in particular it has obtained the exemption, deferral or division into instalments of overdue payments or suspension of the full implementation of the decision of the competent authority, b) its liquidation or bankruptcy has not been opened.8..6 The documents (EDOC/ECP or the originals of the documents from which ECOPDOC/ECP has been drawn up) referred to in paragraph 8.5.2(a) above shall be issued not earlier than three months before the deadline for submission of tenders. The documents (EDOC/ECE or the originals of the documents from which ECOPDOC/ECE has been drawn up) referred to in points 8.5.1. and 8.5.2(b) must be issued no earlier than six months before the deadline for submission of tenders8 ..7 If in the country where the Economic Operator has its registered office or place of residence or domicile of the person to whom the document refers, the documents referred to in item 8.5 above shall not be replaced by a document containing a declaration of the Economic Operator, indicating the person or persons authorized to represent the Economic Operator or a declaration of the person concerned, submitted to a notary or a judicial, administrative or professional or economic self-government body competent for the Economic Operator's registered office or domicile or place of residence of that person [ECOPDOC/EPK], respectively. The provisions of clause 8.8 shall apply accordingly.8.8 The Economic Operator having its registered office in the territory of the Republic of Poland in relation to a person residing outside the territory of the Republic of Poland to whom the document referred to in clause 8.8 applies. 8.3.1. this document shall be submitted within the scope specified in Article 24(1)(a) of this Regulation. 14) and 21) of the PPL. If, in the country of residence of the person to whom the document was intended to apply, such documents are not issued, they shall be replaced by a document containing a declaration by that person before a notary or before a judicial, administrative or professional or economic self-government body having jurisdiction over that person's place of residence [ECOPDOC/EPK]. The document (original document from which ECOPDOC/EPK was drawn up) should be issued not earlier than 6 months before the deadline for submission of tenders.{-> #8#} Delivery of editors of legal acts (#EDITOR) in accordance with the Appendix "Part 03 OPZ" - a total of 8 pieces of the Contracting Authority does not require a guarantee for the subject of the contract. If the manufacturer of a given component of the subject of the contract grants a warranty for this component, the warranty period indicated by the manufacturer applies. The subject matter of the Agreement includes in particular: a. b. providing the Contracting Authority with a license to use the aforementioned software packages,{#8#}8.9 In case of doubts as to the content of the document submitted by the Contractor, the Contracting Authority may request the competent authorities of the relevant country where the Economic Operator has its registered office or place of residence or place of residence of the person concerned to provide the necessary information concerning this document. 8..10 If it is necessary to ensure the proper conduct of the procurement procedure, the Awarding Entity may, at any stage of the procedure, call upon Economic Operators to submit all or some statements or documents confirming that they are not excluded, meet the conditions for participation in the procedure, and if there are reasonable grounds for considering that the statements or documents previously submitted are no longer valid, to submit valid statements or documents.8.11 The Contracting Authority requests from the Economic Operator, which relies on the abilities or situation of other entities pursuant to the principles specified in Art. 22a of the PPL Act, to present with respect to these entities the documents listed in Chapter VI, Part C), item 8.3 of the ToR. D. Information concerning the form of documents:9. If the Economic Operator fails to submit the declaration referred to in Chapter VI. 1 ToR, statements or documents confirming circumstances referred to in Art. 25 par. 1 of the PPL Act, or other documents necessary to conduct the procedure, statements or documents are incomplete, contain errors or raise doubts indicated by the Awarding Entity, the Awarding Entity will call for them to be submitted, supplemented, corrected or to provide explanations within the time limit indicated by itself, unless, despite their submission, the Economic Operator's tender would be rejected or the procedure would have to be cancelled.10If the Economic Operator has not submitted the required powers of attorney or has submitted defective powers of attorney, the Awarding Entity shall call for them to be submitted within the time limit indicated by the Awarding Entity, unless, despite their submission, the Economic Operator's offer would be subject to rejection or it would be necessary to invalidate the proceedings.11. Declarations referred to in the regulation indicated in item II.2.1. 16, concerning the Economic Operator and other entities on whose abilities or situation the Economic Operator relies under the rules specified in art. 22a of the PPL Act and concerning subcontractors, are submitted in the original [EDOC/EPK] or a certified copy [ECOPDOC/EPK].12. Documents referred to in the Regulation, other than the declarations referred to in point A.1.1, are submitted in the original [EDOC/EPK]. 11, are submitted in the original [EDOC/EPK] or a certified true copy [ECOPDOC/EPK].13. The certificate of conformity with the original shall be made by the Economic Operator, the entity on whose abilities or situation the Economic Operator, the Economic Operators jointly bidding for the award of a public contract or a subcontractor, respectively, with regard to the documents which concern each of them.14The certificate of conformity with the original is the result of affixing a qualified signature to an electronic copy of the document [ECOPDOC].15. Documents drawn up in a foreign language are submitted with a translation into Polish.16Within the scope not regulated by the ToR, the provisions of the Ordinance of the Minister of Development of 26 July 2016 on the types of documents which may be requested by the Contracting Authority from the Economic Operator in the procurement procedure.{-> #9#} Delivery of type 1 desktop computers together with the activation of the Trusted Profile Confirmation Points (#KOMP1.PROFIL) according to the Appendix "Part 04 OPZ" - in total 4 pieces. The Ordering Party requires a 24-month warranty period for the subject matter of the contract, counting from the date of final acceptance of the subject of the contract. If the manufacturer of a given component of the subject of the contract grants a warranty for this component for a period longer than 24 months, the warranty period indicated by the manufacturer shall apply. The subject matter of the Agreement includes in particular: a. delivery to the Ordering Party's registered office of the above-mentioned computer set with the trade name at the Contractor's expense, to the premises indicated by the Ordering Party, b. providing the Ordering Party with a license to use the operating system of the device, c. running the above-mentioned computer set at the Ordering Party's registered office, d. providing the documentation required by the Ordering Party in the ToR, e. f. providing a guarantee for the above-mentioned device.{#9#}17 In case of indicating in Appendix 3 to the ToR (ONE) by the Economic Operator the availability of statements or documents submitted in order to confirm that the conditions for participation in the procedure are met or that there are no grounds for exclusion, in electronic form [EDOC or EDOC/EPK] at specified Internet addresses of publicly available and free databases maintained by authorised bodies or institutions, the Contracting Authority will download the statements or documents indicated by the Economic Operator from these databases.18.If the Economic Operator indicates in Appendix No. 3 to the ToR (ONE) the availability of statements or documents submitted in order to confirm that the conditions for participation in the procedure are met or that there are no grounds for exclusion, which are in the possession of the Contracting Authority, in particular statements or documents kept by the Contracting Authority pursuant to Art. 97 (1) of the PPL Act, the Contracting Authority will use the statements or documents in its possession, provided that they are up to date.19The Ordering Party may require the Contractor to provide a translation into Polish of the statements and documents indicated by the Contractor and downloaded independently by the Ordering Party, referred to in item A.2.1. 17 and 18.E. Information on the protection of individuals with regard to the processing of personal data and on the free movement of such data:20. In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ L 281, 15.10.2016, p. 1). The subject of the Agreement covers in particular: a. delivery to the Ordering Party's registered office of the above-mentioned notebooks with the trade name at the Contractor's expense, to the premises indicated by the Ordering Party, b. providing the Ordering Party with a license to use the operating system of the device, c. providing a guarantee for the above mentioned device. Delivery of tablets (#TABLET) according to the Appendix "Part 10 of OPZ". - a total of 65 pieces. The Ordering Party requires a 24-month warranty period for the subject matter of the contract, counting from the date of final acceptance of the subject of the contract. If the manufacturer of a given component of the subject of the order grants a guarantee for this component for a period longer than 24 months, the guarantee period indicated by the manufacturer applies. The subject of the Agreement covers in particular: a. delivery to the Ordering Party's registered office of the above-mentioned tablets with the trade name at the Contractor's expense, to the premises indicated by the Ordering Party, b. providing the Ordering Party with a license to use the operating system of the device, c. providing a guarantee for the above mentioned device. Delivery of emergency power supplies (#UPS1) according to the appendix "Part 11 OPZ" - total of 58 units. The Ordering Party requires a 24-month warranty period for the subject matter of the contract, counting from the date of final acceptance of the subject of the contract. If the manufacturer of a given component of the subject of the contract grants a warranty for this component for a period longer than 24 months, the warranty period indicated by the manufacturer shall apply. The subject matter of the Agreement includes in particular: a. delivery to the Ordering Party's registered office of the above mentioned emergency power supplies under the trade name at the Contractor's expense, to the premises indicated by the Ordering Party, b. providing a guarantee for the above mentioned device. Delivery, installation and commissioning of the server room emergency power supply system (#AGREGAT) according to the Appendix "Part 12 OPZ" - 1 piece. The Ordering Party requires a 24-month warranty period for the subject matter of the contract, counting from the date of final acceptance of the subject of the contract. If the manufacturer of a given component of the subject of the order grants a warranty for this component for a period longer than 24 months, the warranty period indicated by the manufacturer applies. The subject of the contract includes in particular: a. adaptation of the room indicated in the SOPZ, in which the unit will be located for the needs of proper operation of the unit,b. delivery to the Ordering Party's seat of the generator under the trade name at the Contractor's expense to the room indicated by the Ordering Party in SOPZ, c. establishment of the above mentioned unit, d. delivery to the Ordering Party's seat of the equipment provided in SOPZ at the Contractor's expense to the room indicated by the Ordering Party in SOPZ, e. installation of the above mentioned equipment and starting up the emergency power supply system in accordance with SOPZ, f. providing guarantees for the above mentioned equipment. Delivery and commissioning of the management system for educational institutions (#OŚWIATA.L) in accordance with the Appendix "Part 13 OPZ" - 1 piece. The Ordering Party requires a 60 month warranty period for the subject matter of the contract, counting from the date of final acceptance of the subject of the contract. If the manufacturer of a given component of the subject of the order grants a guarantee for this component for a period longer than 60 months, the guarantee period indicated by the manufacturer applies. The subject of the Agreement covers in particular: a. supply of software ,b. configuration, testing and launching of the above-mentioned software,c. feeding the subject of the Agreement with the data held by the Ordering Party,d. providing the Ordering Party with the documentation specified in the Agreement,e. providing the license to use the subject of the Agreement in accordance with the Agreement,f. conducting instructions necessary for the use of the subject of the Agreement by the Ordering Party's employees,g. providing guarantees for the above-mentioned software running on the terms specified in the Agreement. Delivery and commissioning of the management system for educational institutions (#OŚWIATA.U) in accordance with the Appendix "Part 14 OPZ" - 1 piece. The Ordering Party requires a 60 month warranty period for the subject matter of the contract, counting from the date of final acceptance of the subject of the contract. If the manufacturer of a given component of the subject of the order grants a guarantee for this component for a period longer than 60 months, the guarantee period indicated by the manufacturer applies. The subject of the Agreement covers in particular: a. supply of software ,b. configuration, testing and launching of the above-mentioned software,c. feeding the subject of the Agreement with the data held by the Ordering Party,d. providing the Ordering Party with the documentation specified in the Agreement,e. providing the license to use the subject of the Agreement in accordance with the Agreement,f. conducting instructions necessary for the use of the subject of the Agreement by the Ordering Party's employees,g. providing guarantees for the above-mentioned software running on the terms specified in the Agreement.
