Description

The subject of the order is the successive supply of dairy products to the Police School in Piła in the approximate amount of 13,010 kg.A detailed description of the subject of the order and a complete list of the assortment to be supplied and the maximum quantity of the ordered products are given in the Assortment and Quantity Specification, which constitutes Appendix No. 2 to the SWZ. This attachment is part of the offer, and therefore must be submitted in the form provided for the offer. The quantities given are estimates and do not obligate the Ordering Party to purchase products in these quantities.
The Ordering Party reserves the right not to fulfill the subject matter of the order by up to 50% of the total gross remuneration. The Contractor shall not be entitled to any financial or legal claims for failure to fulfill part of the order. Delivery, unloading and lifting of the subject matter of the order will be carried out at the expense of the Contractor included in the price of the products covered by the public procurement contract. Delivery of the subject matter of the order will be carried out by the Contractor's means of transportation permitted to transport food. The Contractor shall have a current certificate of entry in the register of establishments subject to official inspection by competent authorities - in accordance with the Act of August 25, 2006 on food and nutrition safety (i.e. Journal of Laws of 2022, item 2132) or a current administrative decision on entry in the register of establishments or on approval of an establishment issued by the district veterinarian, together with the assigned identification number in accordance with Article 21 (4) of the Act of December 16, 2005 on products of animal origin (i.e., Journal of Laws of 2020, item 1753, as amended). The contractor must be under the constant supervision of the competent authorities. The offered products must meet the requirements listed in the applicable legislation on food production and marketing. Each product must be produced and marketed in accordance with the requirements of the HACCP system. The Contracting Authority does not divide the contract into parts. Thus, the Contracting Authority does not allow the submission of partial bids, as referred to in Article 7(15) of the PPL Act. Reasons for not dividing the contract into parts: The contract is homogeneous in subject matter and function, moreover, the size of the contract does not in any way hinder small and medium-sized entrepreneurs from submitting an offer. Common Procurement Vocabulary (CPV) names and codes: CPV 15500000-3 - dairy products.The draft provisions of the contract for the public procurement in question, which will be introduced into the content of the contract, are set forth in Appendix No. 3 to the SWZ. The Contractor shall be obliged to execute the order on the terms and conditions described in the Draft provisions of the contract, attached as Annex No. 3 to the SWZ. The order will be implemented successively: from the date of signing the contract until April 30, 2023 or until the amount of the total gross remuneration under the contract is previously exhausted. The planned date of commencement of the contract from the date of the first delivery in 2023, no later than February 01, 2023. With reference to Article 455 (1) (1) of the Law, the Contracting Authority reserves the possibility of extending the contract execution date up to 2 months after the date specified in the contract, within the financial resources specified for this purpose, and requesting the conclusion of an annex to the contract in this regard, in the event that the financial resources under the contract are not exhausted within the stipulated period and the Contractor has not yet been selected as a result of the subsequent procedure. The contracting authority informs that in the event of circumstances related to the occurrence of COVID-19, which affect or may affect the due performance of the subject of the contract, the contract may be amended. In the event of interruption in the operation of the Food Section kitchen of the Police School in Pila or suspension of courses by the Police School in Pila, due to the outbreak of COVID-19 coronavirus, the Ordering Party reserves the right to request an amendment to the contract by extending the term of the contract by the time during which the contract was not executed, while maintaining the terms and prices specified in the Assortment and Quantity Specification, which will be an annex to the contract. Deliveries of goods will take place 5 times a week from Monday to Friday from 10:00 to 13:00 at the expense and risk of the Contractor. In justified cases, the Ordering Party may require the Contractor to carry out deliveries also on Saturdays from 10:00 a.m. to 1:00 p.m. Place of execution: food warehouse of the Food Section of the Police School in Piła, Plac Staszica 3.
