Description

Equipment:1) meets all technical parameters described in Annex 1a and is brand new, i.e. not used before the date of delivery (it has no physical or legal defects), complete, ready to use without additional purchases and investments;2) is marked (including the "CE" marking) in accordance with the requirements set out in the Act of 13.4.2016 on conformity assessment and market surveillance systems (i.e. Journal of Laws of 2019, item 544, as amended);3) if it is an energy-related product within the meaning of Article 2 of the Act of 14.9.2012 on energy labelling of energy-related products (uniform text: Journal of Laws of 2016, item 1790, as amended).) has:(a) labels in Polish attached to the energy-related product, which shall contain information on the energy efficiency class (energy consumption or the impact of the product on energy consumption) and other essential resources (water, chemicals or other substances) used by the energy-related product ...the law. 4...The Ordering Party's representative, referred to in section 6, shall refuse to accept the delivered equipment in the event of: 1) discrepancies between the characteristics of the delivered equipment and those presented in the offer, subject to changes made pursuant to § 10 section 1 item 2; 2) damage or defect making it impossible to use the equipment to the full extent; 3) failure to perform or defective performance of its assembly, installation, checking its operation, training of Ordering Party's persons - in accordance with § 1 section 2.
