The apparatus must be compatible with the mass spectrometer Thermo Scientific™ LTQ Orbitrap XL,2)be brand new, i.e. it must be compatible with the mass spectrometer Thermo Scientific™ LTQ Orbitrap XL,2)be brand new, i.e. it must be compatible with the mass spectrometer Thermo Scientific™ LTQ Orbitrap XL,2)be brand new. not used before the date of delivery (it is required that it has no physical or legal defects), complete, ready to use without additional purchases and investments,3) be delivered to the Ordering Party in original factory packaging, whose storage by the Ordering Party is not required to keep the guarantee granted,4) be marked (including the "CE" marking) in accordance with the requirements set out in the Act of 13 April 2016 on conformity assessment systems and market surveillance (uniform text: Journal of Laws of 2009, No. 33, item 659, as amended), and in accordance with the requirements set out in the Act of 13 April 2016 on conformity assessment systems and market surveillance (uniform text: Journal of Laws of 2009, No. 33, item 659, as amended). 2017, item 1398, from 2018. item 650, 1338 as amended),5) if it is an energy-using product within the meaning of Article 2 of the Act of 14 September 2012 on informing about the energy consumption of energy-using products and control of the implementation of the labelling programme for office equipment (i.e. Journal of Laws of 2016, item 1790 as amended),5) if it is an energy-using product within the meaning of Article 2 of the Act of 14 September 2012 on informing about the energy consumption of energy-using products and control of the implementation of the labelling programme for office equipment (i.e. Journal of Laws of 2016, item 1790 as amended).) have: (a) labels attached to the energy-using product, in Polish, containing information on the class of energy efficiency (energy consumption or the impact of the product on energy consumption) and other essential resources (water, chemicals or other substances) used by the energy-using product; (b) attached to brochures or other documentation supplied with the energy-using product; (c) attached to a card drawn up in Polish, containing a table with technical information on the energy-using product; (d) data in accordance with the technical parameters of the energy-using product on the label and in the card; in accordance with the requirements of the aforementioned Acts; (e) attached to brochures or other documentation supplied with the energy-using product, a card drawn up in Polish, containing a table with technical information on the energy-using product; (f) placed on the label and in the card, data consistent with the technical parameters of the energy-using product; in accordance with the requirements of the aforementioned Acts; in accordance with the requirements of the aforementioned Acts.The Ordering Party's representative shall refuse to accept the delivered equipment if: 1) there are discrepancies between the characteristics of the delivered equipment and those presented in the offer, subject to changes made pursuant to § 10 sec. 1 item 2 of the Act on Public Procurement. 3) failure to perform or faulty performance of its installation, checking the operation and training of the Ordering Party's personnel. 9. 8 a representative of the Contracting Authority shall draw up a report containing the reasons for refusal to accept the equipment, and the Economic Operator shall immediately deliver the equipment in accordance with the submitted offer and/or correct performance of the order. If the deadline for delivery and/or correct performance of the order exceeds the deadline for performance of the order referred to in § 2 of the contract, the Purchaser shall calculate a contractual penalty to the Contractor in accordance with § 8 paragraph 1 item A.1 of the contract notice. 1.10. Pursuant to Art. 24aa of the Act, the Contracting Authority shall first evaluate the bids for rejection - Art. 89 par. 1 of the Act and the criteria for evaluating the bids as specified in chapter XIV of the ToR, and then examine whether the Economic Operator whose bid has been assessed as the most advantageous is not subject to exclusion, meets the conditions for participation in the tender and meets the requirements specified by the Contracting Authority based on the declarations and documents indicated in chapter VII.11.Communication between the Contracting Authority and the Economic Operators, in particular submission of declarations, applications, notifications and transmission of information is done electronically using a dedicated form available on ePUAP https://obywatel.gov.pl/nforms/ezamowienia and made available by the miniPortal (Communication Form) https://miniportal.uzp.gov.pl/. (for details see Chapter VIII of the ToR). The maximum size of files sent via the Communication Form is 150 MB. In particular, the Contracting Authority shall accept the following data formats: .pdf, .doc, .docx, .docx, .rtf, .xps, .odt.
