Description

Framework agreement pursuant to Article 54, paragraph 3 of Legislative Decree no. 50/2016. The maximum total amount for the framework agreement including safety charges is EUR 9 000 000,00 plus VAT, made up as follows: EUR 8 753 000,00 for work to be carried out and EUR 247 000,00 for non-reduced safety charges. The maximum amount provided for represents the sum of the individual application contracts that may be concluded under the framework agreement. Since this is a framework agreement, the discount offered by the successful tenderer on the price list of works does not affect the value of the contract to be concluded, which will remain unchanged, given that the amount of EUR 9 000 000,00 plus VAT represents the maximum amount that can be spent over the duration of the framework agreement by SALT pa Tronco Ligure Toscano on the individual works contracts, which will be remunerated by applying the reduced unit prices according to the percentage offered by the economic operator. The compensation for each application contract will be determined by applying the unit price list net of the offered percentage discount plus the amount of the security charge. The contract will be compensated to measure. Pursuant to Article 23, paragraph 16, of Legislative Decree no. 50/2016 (hereinafter also referred to as the Code), the amount used as the basis for the tender includes the labour costs that the Contracting Authority has estimated at 24.135 % of the amount of the works, excluding VAT and security charges. Breakdown by category (art. 84 of the Code and Ministerial Decree no. 248/2016): - Cat OG3 (prevalent) Amount 7 800 000,00 EUR including safety charges Class VI Subcontracting yes Qualification Obligatory, - Cat OS11 (separable) Amount 1 200 000,00 EUR including safety charges Class III Subcontracting yes Qualification Obligatory, Competitors may benefit from the increase in the classification within the limits and under the conditions indicated in art. 61, par. 2 of Presidential Decree no. 207/2010 as in force. The present contract cannot be divided into lots as it is an intervention which, for safety reasons, must take place in phases that are closely coordinated with each other. The framework agreement will have a duration of 1 095 natural and consecutive days starting from the relative stipulation of the contract, except in the case of early termination in case of exhaustion of the maximum amount provided for or in the cases provided for in point VI.3) letter S. Works carried out in self-financing. The successful bidder will receive an advance payment equal to 20% of the amount of each single application contract activated by the framework agreement, in accordance with the conditions and procedures indicated in Article 35, paragraph 18, of the Code. Payments will be made on the basis of two-monthly progress reports and the final balance. The accounting for the works will be carried out in accordance with the regulatory rules on public works. Subcontracts will be regulated in accordance with art. 105 of the Code and other applicable regulations in force. Pursuant to Article 105(2), subcontracting may not exceed 30 % of the total amount of the contract calculated on the progressive total amount of the application contracts signed. This is without prejudice to the further limitation of 30 % set out in paragraph 5 of the same Article 105 for the works set out in Article 89 paragraph 11 of the Code. It is understood that according to the provisions of Article 1, paragraph 2 of Ministerial Decree no. 248 of 10.11.2016, the limit referred to in the aforementioned Article 89, paragraph 11, of the Code is not taken into account for the purposes of reaching the limit referred to in Article 105, paragraph 2, of the Code. The competing economic operator may resort to subcontracting only if it indicates in the tender the works or parts of works it intends to subcontract as well as the triad of subcontractors with reference to the category of works provided for in the tender notice. Subcontractors participating in this procedure may not be indicated as competitors. Pursuant to Article 31, paragraph 10 of the Code, the person responsible for the procedure is Andrea Minuto (see I.1).
