The subject matter of the contract is the design and execution of construction works for the task entitled: "Construction of the Fire Station of the Municipal Headquarters of the State Fire Service in Ruda Śląska "will be implemented in the formula design and build2. (3) A detailed description of the subject matter of the contract is contained in the functional-utility program, hereinafter referred to as PFU, together with annexes.4. Additional conditions for the execution of the contract are specified in the draft provisions of the contract.

In view of the above, Article 99 (5) and (6) of the PPL Act does not apply; 2) the description of the subject matter of the contract contained in the PFU together with the Annexes to the SWZ does not refer to the standards, technical evaluations, technical specifications and technical reference systems referred to in Article 101 (1) (2) and (3) of the PPL Act. In view of the above, Article 101(4) of the PPL Act does not apply. 3) Should the contract documentation contain proprietary names, references to standards or technical approvals, or wording indicating a specific product, the Contracting Authority shall allow the use of equivalent solutions, and the criterion of equivalence shall be deemed to reflect the main features of the product relevant to its function and the technology used.7. The Contracting Authority does not require the submission (with the bid) of the evidence in question
