The subject of the contract is to design. The subject matter of the contract shall include, in particular:1) Development of project documentation - detailed design for development of investment areas for industrial function in the northern part of the City of Slupsk on the basis of PF. 1) development of project-execution documentation for development of investment areas for industrial function in the northern part of the City of Slupsk on the basis of PFU, together with obtaining a decision on permission to execute a road investment (ZRID) and any other administrative decisions, arrangements and opinions necessary to execute the investment task, in accordance with applicable regulations, the necessity to conduct proceedings aimed at issuance of a water permit, environmental decision, including (if necessary) preparation of an Information Sheet of the project and/or Environmental Impact Report,2) execution of construction works on the basis of obtained administrative decisions, referred to in item 1 and the design documentation prepared by the Contractor, together with the notification of completion of construction works/permit to use to the competent construction supervision authority,3) ensuring, for the duration of the contract, technical staff with qualifications/authorizations appropriate for the performance of all elements included in the scope of the contract.2. The Contracting Authority informs that the PFU is not an exhaustive document in terms of all requirements and cited regulations and the Contractor should take this into account when preparing the design documentation. PFU may not include all details necessary for the development of project documentation. The Contractor may not use any errors or omissions in PFU to evade the execution of project documentation. in accordance with applicable laws and regulations and proper execution of works.3. The Contracting Authority requires that the fleet used by the Contractor for the execution of the contract includes at least 10% of vehicles powered by electricity or natural gas.8.. the Contractor must have, throughout the term of the contract, third-party liability insurance in respect of its business activities, including for damages caused in connection with the execution of the contract.9.. conditions contained in the preliminary Promissory Note Edition5RSP/2022/351/PolskiLad are described in the proj. agreement, including: payment of the subsidy in two tranches - the first after the completion of a separate stage of work in the implementation of the investment, the second - after the completion of the investment:1) the first tranche in the amount of no more than 50% of the amount of the subsidy,2) the second tranche in the amount of the remaining amount of the subsidy to be paid.10. the Contractor, in accordance with the terms of the Preliminary Promissory Note, shall provide financing for the part of the investment not covered by the Ordering Party's own share, for the time preceding disbursements from the Promissory Note, on the terms indicated in the draft agreement.11The Ordering Party and the Contractor undertake to submit any disputes in civil law claims in matters in which settlement is permissible to mediation or other amicable dispute resolution before the Arbitration Court at the General Prosecutor's Office of the Republic of Poland, a selected mediator or a person conducting other amicable dispute resolution.12 .Disputes that cannot be resolved amicably, arising out of the execution of this order (contract) shall be resolved by a common court of law having jurisdiction over the registered office of the Purchaser.13. The subject matter of the contract has been described in detail in the contract documents. The terms and conditions for the execution of the contract are indicated in the proj. agreement - attachment No. 9 to the SWZ.
