NOTICE OF PUBLIC CALL FOR TENDERS
GARANTIE CONSTRUCTION RÉSIDENTIELLE (hereinafter "GCR") wishes to obtain bids for a construction contract.

Location and Timeframe/Contract Duration :
The work concerns a building located at 1015 (#401 & #402) boulevard de Palerme, La Prairie.

The work is to be performed between August 5 and September 27, 2024.

Tender documents can be obtained from the SÉAO (Système électronique d'appel d'offres) by going to "seao.ca". Documents can be downloaded at a cost set by SÉAO. SÉAO assistance is available Monday to Friday, 8:30 a.m. to 5 p.m., at 1 866 669-7326.

Receipt and opening of bids :

1 Purpose of the call for tenders
GCR is seeking tenders for a construction contract for a building located at 1015 (#401 & #402) boulevard de Palerme, La Prairie (hereinafter the "Work").
The Work required is more fully described in the description attached to these instructions.
2 Tender Documents, Schedules and Addenda
Tender documents must be obtained via the SÉAO portal (Système électronique d'appel d'offres: http://www.seao.ca) or by calling 1 866 669-7326. Obtaining documents is subject to the conditions and rates of this organization.

Tender documents, any documents to which they refer, as well as any additional documents (addenda) linked to them, can only be obtained via this system.

These documents are written in French. No translation is provided by GCR.

Where electronic forms are provided, they form an integral part of the tender documents. The bidder may not modify or alter them in any way, failing which the bid will be rejected. The use of such forms does not relieve the bidder of its obligation to submit its bid in paper format.
3.Document review, clarifications and modifications
Tenderers must ensure that they have received all published tender documents. Unless it is notified to the contrary before the deadline for receipt of bids, it will be deemed to have received them all.

Tenderers must carefully examine the tender documents and all other documents forming an integral part thereof. It is the bidder's responsibility to inform himself of the purpose and requirements of the contract.

By submitting its bid, the tenderer acknowledges having read the tender documents and accepts without reservation the clauses, charges and conditions therein.

Tenderers who wish to obtain additional information, who find ambiguities, omissions or contradictions, or who have doubts about the meaning of the contents of the tender documents, must submit their questions in writing to the project manager. Any verbal information obtained in connection with the call for tenders is not binding on GCR.

GCR reserves the right not to consider a bidder's request for clarification if such request is received less than 3 working days prior to the closing date and time for receipt of bids.

When the information requested or the questions raised entail modification of the tender documents, the response is sent to bidders via the SÉAO, by means of an addendum.

GCR reserves the right to make amendments to the tender documents prior to the date and time set for the receipt of bids and, if applicable, to change the deadline for the receipt of bids. Amendments become an integral part of the tender documents and are transmitted, by means of an addendum, to all companies via the SÉAO.
4.site visit
Site visits are mandatory. Bidders' participation in a site visit is a prerequisite for submitting a bid.

5.modification and withdrawal of bids
Bidders may withdraw their bids before the public opening date and time. He may then submit a new bid within the prescribed time.
6 Tender presentation and content
The bidder must submit a bid accompanied by the following documents:


Tender form and price breakdown;
Project schedule, including completion date;
Proof that the bidder holds the appropriate license.
Proof of insurance in compliance with the requirements of this call for tenders;
Revenu Québec certificate.

7 Tender form
The tender form, as well as any other complementary tender form, must be duly and legibly completed in French, indicating the prices submitted or any other information required by the call for tenders document. It must also be signed by the bidder or any other person authorized to sign the bid documents on his behalf.
8.legal tender
All monetary references in the tender documents, whether for prices, certified cheques, bonds, guarantees, insurance, premiums, salaries, payment certificates or any other financial transactions, mean the legal currency of Canada.
9. submitted price
The price submitted must be indicated in figures on the bid form, in the appropriate places.
The Quebec Sales Tax (QST) and the Goods and Services Tax (GST) must be shown separately from the bid price, since taxes are not included in the contractor's determination.
10. lump-sum prices
The lump-sum prices submitted must include, but not be limited to, overhead, administrative costs, fringe benefits, profits and other indirect costs inherent in the contract and, where applicable, travel, meal, licensing and insurance costs or any other costs that will be incurred in carrying out the work required by this call for tenders.

Prices quoted are firm for the duration of the contract.
11.unit prices
The unit prices submitted include overhead, administrative costs, fringe benefits, profits and other indirect costs inherent in the contract and, where applicable, travel, meal, license and insurance costs or any other costs that will be incurred for the performance of the work required by this call for tenders. Prices quoted are firm for the duration of the contract.

Quantities are indicated for the purpose of calculating the price submitted. They constitute an estimate of the work required and may vary according to the needs required. They are not binding on GCR.



12. bid validity period
The bid shall be valid for a period of 45 days following the date of the public opening of bids. GCR may ask bidders to extend this period before the end of the initial validity period.
13.signature authorization
The bid must be signed by an officer of the company appearing in the Registre des entreprises du Québec (REQ).
14.declaration and status of bidder
The Tenderer must sign and attach to its tender the form attached as Appendix 3 - Attestation relative à la probité du soumissionnaire attesting under oath, in particular, that it has prepared its tender without collusion, in good faith and in compliance with the law, including the law relating to influence communications. Any false or incomplete declaration by the bidder may result in rejection of the bid or termination of the contract.

In order to establish its status, the bidder shall attach to its bid the declaration of registration provided for in the Act respecting the legal publicity of sole proprietorships, partnerships and legal persons (chapter P-45).
15 Receipt and analysis of bids
15.1Opening of bids
All bids received by the deadline will be publicly opened in the presence of at least 2 witnesses at the date, time and place specified in the tender documents. Any bidder may attend the bid opening. The names of the bidders and their total prices submitted will then be declared aloud.

Receipt and opening of bids is subject to examination of the eligibility of bidders and the conformity of their bids.

Opening results are available through the SÉAO.
15.2Tender analysis and request for clarification
Bids submitted are subject to an analysis of the eligibility of participating bidders and the conformity of their bids.

GCR may request clarification.

Once this analysis has been completed, a recommendation will be forwarded to the competent authority for a decision on the outcome of the call for tenders.
15.3Conditions of eligibility
Tenderers are not eligible to bid:


who does not possess the qualifications, authorizations, permits, licenses, registrations, certificates, accreditations and attestations required to perform the contract;
does not have in Quebec, or in a territory covered by an intergovernmental market liberalization agreement applicable to GCR, an establishment where it carries out its activities on a permanent basis, clearly identified in its name and accessible during normal business hours.

Tenderers who do not have an establishment in Quebec where they carry out their activities on a permanent basis, clearly identified in their name and accessible during normal business hours, must submit with their tender the form attached in Appendix 4 - Attestation d'absence d'établissement au Québec, duly completed and signed by the authorized person;

is registered with the Registre des entreprises non admissibles aux contrats publics (RENA) and whose period of ineligibility for public contracts has not yet expired;
who, having a place of business in Quebec, does not hold, at the time of submitting his bid, a valid attestation issued by Revenu Québec, called an "Attestation de Revenu Québec". Attestations issued after the deadline for receipt of bids will not be considered.

Tenderers must obtain this attestation by using the online services Clic Revenu - Entreprises on the Revenu Québec website at the following address: http://www.revenuquebec.ca/fr/amr/.


Does not meet any other eligibility condition stipulated in the tender documents.

15.4Charter of the French language
In accordance with the Charter of the French Language (chapter C-11), the Organisme may not enter into a contract with a company:

on the list maintained by the Office québécois de la langue française of companies that have been refused the issuance of an attestation or have had an attestation or certificate suspended or cancelled;
employing 25 people or more, if it does not hold an attestation of registration, has not provided, within the prescribed time, an analysis of its linguistic situation, does not hold an attestation of program application or a francization certificate.

The Organisme verifies the company's registration on the list maintained by the Office. However, it is the responsibility of each company covered by paragraph b) to submit the necessary documents to establish its eligibility to enter into the contract.
15.5Attestation from Revenu Québec
All bidders with an establishment in Québec must hold a certificate issued by Revenu Québec that is valid at the date and time set for the receipt of bids.
This attestation indicates that, on the date indicated, the bidder has filed the declarations and reports it is required to file under tax legislation and that it has no outstanding accounts payable to the ministre du Revenu du Québec, in particular where its collection has been legally suspended or where arrangements have been made with it to ensure payment and that it is not in default in this regard.
Applicants who do not have an establishment in Québec where they carry out their activities on a permanent basis, clearly identified in their name and accessible during normal business hours, must, in lieu of such an attestation, complete and sign the "Attestation relative à l'absence d'établissement" form attached as Appendix 4 and submit it with their bid.

15.6Conditions of compliance
All bids will be deemed non-compliant and automatically rejected in the following cases:


it has not been transmitted to the designated location or before the date and time set for the submission of bids, unless, in the case of a bid received late, the delay is attributable solely to GCR;
it has been transmitted by a means that does not comply with the tender documents;
in the case of a bid submitted electronically :

it was not submitted via the electronic tendering system ;
it is unintelligible, infected or otherwise illegible once its integrity has been established by the electronic tendering system;
when the integrity has not been established and the bidder has not remedied this irregularity within 2 working days following the notice of defect sent by the DGC;


it is not accompanied by the bidder's undertaking or price document, or in the absence of the required signature of an authorized person on either of these documents;
it is conditional or restrictive as to the requirements of the tender documents;
it comes from a bidder who has submitted more than one bid, either directly or indirectly through another person linked to him; in this case, all his bids are rejected; the fact of having transmitted a bid electronically and on paper is treated as the transmission of more than one bid and results in their rejection;
it fails to comply with any other compliance condition indicated in the tender documents as automatically resulting in the rejection of a bid.

GCR may, at its sole discretion, reject any bid that contains a false or misleading statement or information.

GCR may, at its sole discretion, overlook any other defect or failure to comply with the requirements of the Tender Documents, which action shall not result in the rejection of such Tender, provided the Tenderer corrects such defect or failure to GCR's satisfaction within the time allowed by GCR. Such correction may not have the effect of improving the quality of the bid with respect to elements not already contained in the bid or of upsetting the balance between bidders.
15.7 Abnormally low prices
A bid is non-conforming and must be rejected, after authorization by the officer of GCR pursuant to the provisions of Section IV.1 of the Règlement sur les contrats de travaux de construction des organismes publics , if it contains an abnormally low price.
15.8Liability insurance
The bidder must hold, at the time of submission of its bid, a liability insurance policy for a minimum amount of $2,000,000 per claim.

Proof of insurance complying with the requirements of this call for tenders must be provided with the bid.
16 Contract award
The contract is awarded to the lowest-priced bidder whose bid complies with the provisions of the call for tenders.

In the event of a tie following a call for tenders, the contract is awarded by lot.
17 Reservations
GCR does not undertake to accept the bid offering the best price or any of the bids received.

At its sole discretion, GCR may cancel the call for tenders, in particular when an insufficient number of bids has been received.

GCR reserves the right to refuse a bid from a company which, within the two years preceding the bid opening date, has been evaluated by GCR for unsatisfactory performance, has failed to respond to a bid or contract, or has had a contract terminated for failure to comply with its terms.
18 Award decision
The decision as to the award of the contract shall be made by the competent authority of GCR.
19.ownership of documents
All tenders submitted and all documents pertaining thereto shall be the property of GCR and shall not be returned to the tenderer, unless otherwise provided in the tender documents. GCR shall have the right to reproduce the bid in whole or in part for its own purposes.
20.Tender Preparation and Submission Costs
Under no circumstances shall the Tenderer be entitled to compensation for costs incurred in the preparation and submission of its Tender.
21.contract to be signed and bidder's default
The successful contractor undertakes to sign the contract attached hereto within ten days of GCR's transmission of the notice of intent to sign the contract. All provisions of this contract form an integral part of the tender documents.

Any Tenderer failing to comply with its tender, in particular by failing to provide the documents required by GCR within 15 days of such request, shall owe GCR a sum of money representing the difference between the amount of its tender and that of the tender subsequently accepted.
22.Use of French Language
GCR, in compliance with the requirements of the Charter of the French Language and in accordance with its Language Policy, requires bidders to use the French language in the presentation of a bid and its appendices.

Failure to comply with these requirements may result in a bidder being declared non-compliant and its bid rejected.

The bidder must comply with the provisions of the Charter of the French Language and its regulations regarding the status and quality of French, particularly in all matters relating to the execution of the contract.
Where reference documents are not available in French, GCR may require certain documents to be translated, at the bidder's expense.

In the event of a contractor's failure to comply with GCR's requirements regarding the use and quality of the French language, it will be notified in writing to rectify the situation within a prescribed period. Failure to comply with such a request places the contractor in breach of section 205 of the Charter of the French Language.

A contractor is responsible for ensuring that his subcontractors respect the use of the French language.
