Acting as a substitute investor for the investment "Design and construction of a new elevator shaft in place of the existing one in the Regional Centre of Occupational Medicine in Gdańsk at 1B Okrag Street". The present proceedings are conducted in an electronic form through the Purchase Platform available at the website http://platformazakupowa.pl/pn/pomorskie, to which a link can be found on the Ordering Party's BIP website https://www.bip.pomorskie.eu/m,12,zamowienia-publiczne.html hereinafter referred to as the Platform. The subject of the contract is to act as a Substitute Investor for the investment consisting in: "Design and construction of a new elevator shaft in place of the existing one in the Regional Centre of Occupational Medicine in Gdańsk at 1B Okrag Street". The scope of works carried out by the Contractor has been defined in the "Functional and utility programme for replacement of the external elevator shaft of the building of the Voivodship Centre of Occupational Medicine in Gdańsk, which constitutes Appendix No. 1 to the ToR. List of basic works:- Execution of a multi-discipline project of the new elevator,- Demolition and utilization of the existing elevator,- Construction of a new elevator shaft together with a new passenger crane.2The Contractor will supervise the investment in question together with a team of competent Supervision Inspectors of particular industries, consisting in particular of: 1) monitoring of the investment process; 2) settlement and financial supervision over the investment.3 The coordinator of the Supervision Inspectors' activities will be the Construction Industry Supervision Inspector.4.Wherever standards, approvals, technical specifications and reference systems are referred to in the description of the subject matter of the contract, or where trademarks, parameters or sources of origin (names of manufacturers or equipment) are indicated, these provisions should be treated as examples, and an Economic Operator has the right to apply an equivalent solution in each case, with the proviso that the proposed equivalent solutions must meet at least the design assumptions.6Pursuant to art. 29 sec. 3a of the PPL Act, the Contracting Authority requires that a Contractor or a sub-contractor employ persons performing administrative and office activities, including, among others, financial settlement of the investment, on the basis of an employment contract within the meaning of the Labour Code Act of 26 June 1974. Detailed regulations in this respect are set out in Chapter III of the ToR and model contract (Annex 8 to the ToR)7. Additionally, the Contracting Authority informs that: 1) it does not allow for submission of variant bids; 2) it does not allow for submission of partial bids (the contract has not been divided into parts),3) it does not provide for awarding the contracts referred to in art. 67 par. 1 item 6 of the PPL.4) settlements between the Awarding Entity and the Economic Operator will be conducted in PLN;5) the procedure is conducted in the Polish language;6) does not allow for advance payments;7) does not provide for an electronic auction;8) does not provide for reimbursement of costs of participation in this procedure;9) does not provide for concluding a framework agreement;10) does not provide for establishing a dynamic purchasing system;11) does not stipulate that only Economic Operators indicated in art. 22 sec. 2 of the PPL Act may apply for the award of a part of the contract. The Awarding Entity demands that the Economic Operator indicate the parts of the contract which it intends to entrust with subcontractors and indicate the names of subcontractors (if known).13) The Awarding Entity does not reserve the obligation to perform the key parts of the service contract personally by the Economic Operator.
