The subject matter of the contract is "Purchase and delivery of software for server infrastructure", divided into parts:Part I: Purchase and delivery of software for server infrastructure type ICPart II: Purchase and delivery of software for server infrastructure type IICPart III: Purchase and delivery of software for server infrastructure type III2 Detailed description of the subject matter of the contract has been specified in Part III of SWZ OPZ and in Part IV of SWZ in PPU.3. The contract was included in the plan of proceedings for awarding the contract published in the BZP under No. 2.2.164.The Contracting Authority does not require Bidders to pay a security deposit for Parts I - III.5 The Contracting Authority does not require Bidders to pay a security deposit for Parts I - III
1.Part I of the contract - Purchase and delivery of software for server infrastructure type I1.1.The subject matter of the contract in Part I is the delivery of government licenses entitling to use Microsoft Windows Server Datacenter software or equivalent in the number of: a) 2 units under the basic contract and b) 2 units under the option right.2. Detailed description of the subject matter of the contract has been specified in Part III of the SWZ OPZ and in Part IV of the SWZ PPU.3.Contract completion date3.1.The contract under Parts I, II and III of the contract shall be valid for a period of 5 months from the date of its conclusion.3..2.The subject matter of the contract in parts I-III shall be delivered within a maximum period of 15 calendar days from the date of signing of the contract, or any other shorter period resulting from the Contractor's offer (Note !!.constitutes a criterion for evaluation of tenders).3.In the event that the Ordering Party exercises its right of option in parts I and/or II, and/or III of the contract, the period of 15 calendar days, or any other shorter period offered in the Contractor's offer, shall be counted from the moment of submission of a written request (declaration of intent to exercise the right of option) by the Ordering Party.3.4.The Ordering Party shall be obliged to submit the written request referred to in item 2.3 within 5 months from the date of signing the contract, with the proviso that the written request cannot be submitted not less than 15 days before the end of the contract.3.5.The deadlines for the performance of the Contractor's individual obligations, constituting the subject matter of the contract, have been specified in the Draft Contract Provisions constituting Part IV of the SWZZ and in the description of the subject matter of the contract indicated in Part III of the SWZZ.4..The Contracting Authority does not require the Economic Operator to submit with the tender the said means of proof, and the Contracting Authority does not anticipate supplementing the said means of proof referred to in Article 107(2) of the PPL.5. The Contracting Authority does not stipulate in the description of the subject matter of the contract accessibility for the disabled and design for all users.6. The Contracting Authority does not stipulate the obligation for the Economic Operator to personally perform the key tasks related to the execution of the subject matter of the contract.7..The Contracting Authority does not reserve the obligation of personal performance of key tasks related to the execution of the subject matter of the contract by individual Economic Operators jointly applying for the award.8. Due to the fact that the activities performed by the persons appointed to carry out the public contract do not consist in the provision of labor within the meaning of Article 22 § 1 of the Labor Code, the Contracting Authority does not stipulate the requirement for the contractor or subcontractor to employ people on a contract basis.9..The Contracting Authority does not stipulate a requirement for the Contractor to employ the persons referred to in Article 96.2.2) of the PPL Act.10.The Contracting Authority does not stipulate requirements related to the execution of the contract, as referred to in provision 96.1 of the PPL Act.11.RODO - Information Clause included in the SWZ.12.The Contracting Authority provides for the conduct of proceedings using the procedure specified in Article 139 of the PPL Act.13..The Contracting Authority does not anticipate:a) holding a pre-tender meeting with Contractors and an electronic auctionb) the possibility of awarding contracts referred to in Article 214 (1) (8) of the PPL Act.c) reimbursement of the costs of participation in the proceedings, except in the situation referred to in Article 261 of the PPL Act.d) the requirement or possibility of submitting bids in the form of electronic catal. or attaching catal. electronic to the bid, in the situation referred to in Art.93 of the PPL Act.14. The Contracting Authority does not anticipate that it will cancel the proceedings in the cases referred to in Art.257 of the PPL Act if the public funds that the Contracting Authority intended to allocate to finance the whole or part of the contract have not been awarded to it. Part II of the contract - Purchase and delivery of software for server infrastructure type II1.1 The subject matter of the contract in Part II is the delivery of government licenses entitling to use Microsoft Windows Server Standard software or equivalent in the number of: a) 3 units under the basic contract and b) 3 units under the option right.2. Detailed description of the subject matter of the contract has been specified in Part III of the SWZ OPZ and in Part IV of the SWZ PPU.3. Contract completion date3.1.
