The subject of the order is the delivery of spare parts for the aircraft F-16 C/D Block 52+, hereinafter referred to as "parts". The order was divided into 68 Tasks. The parts supplied under this procedure must comply with the current technical documentation of the aircraft manufacturer F-16C/D Block 52+.2. The purchaser shall only accept the supply of new parts, free from physical and legal defects.3For parts without Shelf Life Code, the date of manufacture shall not be earlier than 1.1.2007. The Contracting Authority provides for the possibility of delivery of goods produced before 1.1.2007, this will be possible only in the case of a written request of the Contractor and with the prior written consent of the Contracting Authority.5 The Contracting Authority requires that the subject of the contract be delivered together with the original CoC document, containing: - name of the part, - date of production, - NSN, P/N, - CAGE CODE (manufacturer), - serial number.6. 5.7 The Economic Operator, apart from documents included in point 5.7. 5 and 6 is obliged to submit a written statement to the Purchaser, which will clearly and transparently indicate the date of production of the subject of the agreement.8 In the case of delivery of the manufacturer's CoC document, in a situation where it will not contain all the data listed in point 5 and 6, it will not be possible to provide the Purchaser with the CoC. 5, the Contractor shall be obliged to issue and deliver with the delivery a document containing the data missing in the CoC.9 In the case of delivering a copy of the manufacturer's document(s), the Contracting Authority requires the copy to be certified "as true to the original" by an authorized representative of the Contractor.10 All documents accompanying the delivery of the subject of the contract should be translated into Polish.11Together with the products, the Contractor shall provide the declaration of conformity of OiB issued in accordance with the Act of 17 November 2006 on the system of conformity assessment of products intended for the needs of national defence and security (Journal of Laws of 2018, No. 114, item 114) and indicated in the Regulation of the Minister of National Defence of 11 January 2013 on the detailed list of products subject to conformity assessment and the manner and mode of carrying out the conformity assessment of products intended for the needs of national defence under the conformity assessment mode (Journal of Laws of 2018, item 1385).12 The Contracting Authority shall allow offering equivalent products. By equivalent product the Orderer shall mean parts with parameters and quality standards identical or better than those indicated (desired) by the Orderer and simultaneously approved for use by the aircraft manufacturer on an aircraft type as defined in paragraph 2. The Contracting Authority provides for an option right, pursuant to art. 34 par. 5 of the PPL, to 100% of the value of the base contract. The exercise of the option right will depend on the actual needs of the Ordering Party and will be initiated on the basis of a written statement of the Ordering Party's will, and the Contractor will be obliged to undertake its execution under the contract in question. The option shall be exercised on the basis of unit prices proposed by the Contractor in the tender form. The contract under the option will be performed under the same conditions as the basic contract. The Contractor shall be entitled to separate remuneration for deliveries under the option right. The Orderer reserves that the part of the order defined as the "right of option" is an entitlement and not an obligation of the Orderer. Failure to complete the order in this respect shall not give rise to any claims by the Contractor against the Principal. The contract extension under the options will be implemented in the following periods: Tasks 1 - 43:30.10.2020 Tasks 44 - 62:4.1.2021 to 29.10.2021 Tasks 63 - 68:3.1.2022 to 28.10.202213. The award of the contract does not involve the release of classified information to the Economic Operator.15A necessary condition for the acceptance of the delivery by the Ordering Party will be presentation by the Contractor of a quality acceptance protocol issued by the District Military Representation - quality clauses for particular tasks specified in the ToR.1.
