Bidders should have completed a contract similar to the Project. The description of an eligible bidder is contained in the Bidding Documents, particularly, in Section II. Instructions to Bidders. Bidding will be conducted through open competitive bidding procedures using non-discretionary pass/fail criterion as specified in the 2016 Revised Implementing Rules and Regulations (IRR) of Republic Act 9184 (RA 9184), otherwise known as the “Government Procurement Reform Act”. Bidding is restricted to Filipino citizens/sole proprietorships, cooperatives, and partnerships or organizations with at least seventy five percent (75%) interest or outstanding capital stock belonging to citizens of the Philippines. Interested bidders may obtain further information from DPWH-Rizal II District Engineering Office and inspect the Bidding Documents at the address given below from 7:00 A.M. – 4:00 P.M. A complete set of Bidding Documents may be acquired by interested Bidders on November 16, 2018 to December 5, 2018 from the address below and upon payment of the applicable fee for the Bidding Documents, pursuant to the latest Guidelines issued by the GPPB, in the amount of Twenty Five Thousand Pesos (₱25,000.00) for Item Nos. 1, 2, 3, 4, 5, 6 & 7. Bidding Documents Fee may be refunded in accordance with the aforementioned Guidelines based on the grounds provided for under Section 41 of the Act and this IRR. It may also be downloaded free of charge from the website of the Philippine Government Electronic Procurement System (PhilGEPS) and the website of the Procuring Entity, provided that bidders shall pay the fee for the Bidding Documents not later than the submission of their bids. The DPWH-Rizal II DEO will hold a Pre-Bid Conference on November 23, 2018 at 10:00 A.M. at the Procurement Office, Ground Floor, Multi-Purpose Building, #16 Westbank Road, Rosario, Pasig City, which shall be open to prospective bidders. Bids must be duly received by the BAC Secretariat at the address below on or before December 5, 2018 until 9:00 A.M. at the Procurement Office, Ground Floor, Multi-Purpose Building, #16 Westbank Road, Rosario, Pasig City. All bids must be accompanied by a bid security in any of the acceptable forms and in the amount stated in ITB Clause 18. Bid opening shall be on December 5, 2018, 9:05 A.M. at the Procurement Office, Ground Floor, Multi-Purpose Building, #16 Westbank Road, Rosario, Pasig City. Bids will be opened in the presences of the bidders’ representatives who choose to attend at the address below. Late bids shall not be accepted. If at the time of the post-qualification procedure, the BAC verifies that any of the deficiencies is due to the contractor’s fault or negligence pursuant to 34.3(b)(ii)(c) of the 2016 Revised Implementing Rules and Regulations of Republic Act No. 9184 (2016 RIRR of RA 9184), the Procuring Entity shall disqualify the contractor from the award without any right to reimburse fees and incidental cost paid for the procurement of infrastructure contract subject of the Bid. The DPWH reserves the right to accept or reject any and all bids, declare a failure of bidding, or not award the contract at any time prior to contract award in accordance with Section 41 of RA 9184 and its IRR, without thereby incurring any liability to the affected bidder or bidders.
