Description

The tender process may be attended by natural or legal persons, Spanish or foreign, who have full capacity to act and prove their economic and financial, technical or professional solvency, and who are not subject to a prohibition on contracting, requirements that must be met at the time of expiry of the deadline for submission of bids. NILSA may contract with bidding companies that participate jointly, in accordance with the provisions of Article 13 of Provincial Law 2/2018. The submission of proposals by interested parties implies the unconditional acceptance by the bidding company of the entirety of this document, without exception or reservation. NILSA may contract with jointly participating bidders. In this case, the grouped bidders will be jointly and severally liable before NILSA, will indicate the participation of each of them and must appoint a representative or sole agent with sufficient powers to exercise the rights and fulfill the obligations derived from the contract until its extinction, without prejudice to the existence of joint powers that may be granted by the companies for collections and payments of a significant amount. If 2 companies participate, the solvency, economic and financial as well as technical or professional, must be accredited by the company with majority participation in the joint venture or grouping, or by one of the companies, in the case of equal participation. If more than 2 companies participate, the solvency must be accredited by the representation of at least 50% of the UTE. In any case, they must be natural or legal persons. The latter when their purpose or activity is directly related to the object of the contract, according to their respective statutes or foundational rules, or when they are duly accredited and have an organization with sufficient personal and material elements for the proper execution of the contract.
