The ITDZ Berlin offers customers of the State of Berlin the procurement of software licenses for decentralized virus protection with corresponding services. In addition, the software products put out to tender are also required by ITDZ Berlin itself and in the environment of the workplace service (ITIS or Berlin PC). For this purpose, ITDZ Berlin, as the customer, concludes an Enterprise License Agreement (ELA) for selected McAfee suites. The rights of use acquired through the ELA agreement are passed on by ITDZ Berlin to its customers by contract, who are referred to as license users of the ELA agreement. The current status of actively operated licenses for all suites is approximately 55,000 nodes. On the basis of the licence rights already acquired under the current ELA contract, the licence users can use this new framework agreement to obtain extensions (renewals) of the suites that they have previously purchased from the ITDZ Berlin. McAfee is offering upgrades for the licenses purchased from the current ELA agreement to our license users. The purchase of McAfee licenses is also intended as a supplementary and replacement purchase for McAfee licensees who did not purchase their licenses through the ELA agreement and thus not through ITDZ Berlin, but who are customers of ITDZ Berlin. The estimated financial volume of the framework agreement, contract value according to § 3 VgV, is approximately 1 500 000 EUR over the entire contract period. It does not represent a maximum purchase that leads to the fulfilment of the contract and thus to the termination of the framework agreement, and there is no obligation to call up the estimated financial volume of the framework agreement. The agreed minimum purchase amounts to EUR 700,000 over the maximum term of the framework agreement. The agreed minimum purchase is reduced accordingly in the case of a shorter term of the agreement. The estimated volume/fictitious quantity structure stated in the price sheet is based on empirical values and non-binding forecasts of the Customer. The stated values are not contractually binding for the client.
