Nature of Requirements:

1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

2. Definition of the requirement
Environment and Climate Change Canada, Observational Based Research Section (OBRS) has a requirement for the supply of one Vertical Pointing Micro Rain Radar system with antenna heating and a tripod pedestal.

One system is to be purchased with options to purchase 2 additional systems over the next 2 fiscal years.

3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:

The system must have the following features:
o use a transmit frequency of 23.5 to 24.5 GHz.
o transmit power < 60W
o be vertically pointing
o provide Doppler data (range resolved)
o have Antenna gain >35 Dbi
o have Beam width <2 degrees
o provide up to 256 range gates
o provide Minimum range resolution 10m
o provide Minimum time resolution 10s
o be self-contained including data processing unit
o include software (Windows 7, 8 or 10 compatible) for data display and system configuration
o have a LAN port for data collection / system configuration in a network environment
o have data storage on removable media
o have antenna heating
o have Power requirements: 120VAC 60 Hz. <700W Total
o have a tripod for temporary installations
o have no single component weighting > 25Kg
o have corrosion resistance components
o include power/data cable min length 20m
o include crate or case to protect antenna during shipping
o The following must be provided:
o Raw spectra of received power
o Rain intensity
o Liquid water content (rain)
o Doppler velocity
o Mean fall velocity (rain)
o Spectra of reflectivity (rain)
o Path integrated attenuation (rain)
o Spectra of attenuated reflectivity
o Melting Layer Detection
o Electronics unit (if separate from sensor unit)

4. Applicability of the trade agreement(s) to the procurement
This procurement is subject to the following trade agreements: the Canadian Free Trade Agreement (CFTA) and the North American Free Trade Agreement (NAFTA)

5. Justification for the Pre-Identified Supplier
ECCC has a number of earlier versions of this instrument and custom software has been developed to extract data from it. The costs of managing multiple versions involve significant programming time and possible delays in installing the unit. There are no known suppliers for this product and ATS Services Ltd is the sole Canadian licensed agent and authorized distributor for the manufacturer.

6. Government Contracts Regulations Exception
The following exception to the Government Contracts Regulations is (are) invoked for this procurement under subsection 6(d) - "only one person is capable of performing the work").

7. Exclusions and/or Limited Tendering Reasons
The following exclusion(s) and/or limited tendering reasons are invoked under the (section of the trade agreement(s) specified):
Canadian Free Trade Agreement (CFTA) – Article(s) 513 (b):
(ii) the protection of patents, copyrights, or other exclusive rights;
(iii) due to an absence of competition for technical reasons;
(v) to ensure compatibility with existing goods, or to maintain specialized goods that must be maintained by the manufacturer of those goods or its representative;

Agreement (NAFTA) – Article(s) Article 1016, 2(b) where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.

8. Period of the proposed contract or delivery date All goods must be delivered on or before 31 March 2020. All optional goods must be delivered prior to the end of the applicable fiscal year.

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above.

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.

Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any procurement.

Documents may be submitted in either official language of Canada.
