Description

The subject of the contract is service care of the hospital IT system CliniNet and modules owned by the ordering party. All activities performed under the contract and functioning of the system are covered by the contractor's guarantee. The Contractor declares that he is the producer of the software referred to in point 1 and/or has a license or other agreement concluded with the producer on the basis of which he can provide service care and guarantee the proper functioning of the application software. The Contractor shall be obliged to update the system to the extent necessary to repair warranty errors. The Contractor shall be obliged to modify and update the system in order to adapt the software to the current legal regulations in force, in particular regulations, acts, valid legal interpretations and requirements of superior units (e.g. National Health Fund, Ministry of Health, others). Modifications and updates must be implemented in the system of the contracting authority before the date of entry into force of the law.The Economic Operator shall be obliged to make the service system available to the contracting authority.The Economic Operator shall be obliged to provide advice on expanding the system with new modules.The Economic Operator shall be obliged to install new versions of the system and modules.The Economic Operator shall be obliged to provide access to consultants for standard service works (preparation of reports, remote consultations).The Economic Operator shall be obliged to provide access to consultants for settlements.The Contractor shall be obliged to provide access to consultants for system software and hardware (operating systems, databases, virtualization, network).The Contractor shall be obliged to update the database engine (provided that the Contracting Authority has purchased the manufacturer's support and rights to update the product).The presence of the Contractor in the scope of additional maintenance services, to the extent offered by the Contractor under the tender evaluation criterion (without the possibility of transferring unused hours to subsequent months) for system software and hardware services (operating systems, databases, virtualization, network) to be used by the Contracting Authority according to its choice during the term of the contract.The Contractor shall be obliged to update the administrator's tools. The Contractor shall be obliged to consult on security mechanisms (backup copies, recovery of data from backup copies). The Contractor shall be obliged to consult on the administration of the operating system and hardware extensions. The Contractor shall be obliged to consult on the administration of the network and network equipment. The parameters of maintenance services have been specified in detail in Appendix 2. When accepting the subject of the agreement, the Contractor undertakes to employ the person referred to in Article 29(2). Detailed conditions for the implementation of the requirements specified by the contracting authority pursuant to art. 29 para. 3a of the Public Procurement Law, in particular the manner of documenting the employment, the contracting authority's powers to control the contractor's compliance with the requirements referred to above and sanctions for failure to meet these requirements are included in chapter XVI of the ToR - provisions relevant to the parties, which will be introduced to the content of the concluded public procurement agreement.
