Description

Detailed description of the subject matter of the contract has been specified in Terms of Reference (Annex 1 to the ToR) and in the model agreement (Annex 2 to the ToR).3 The Contracting Authority does not allow submitting partial offers. The contract does not have any separate parts. The subject matter of the contract is to provide the Contracting Authority with access to one centralized analytical and visualization system. Pre-accessibility stages, including adaptation of the Contractor's system to the Ordering Party's needs, are an integral part of the subsequent provision of this tool. The Ordering Party could not separate the periods of availability, as the system provided by the Contractor will be adjusted to the Ordering Party's needs, so a potential change of the service provider would be disadvantageous for the Ordering Party.
1. not be subject to exclusion pursuant to Art. 108 (1) of the PPL Act, whereunder a contractor is excluded from the award proceedings a) participation in an organised criminal group or in an association with the aim of committing a criminal or fiscal offence, referred to in art. 258 of the Penal Code,b) trafficking in human beings, referred to in art. 189a of the Penal Code,c) referred to in art. 228-230a, art. 250a of the Penal Code or in art. 46 or art. 48 of the Act on Sport of 25 June 2010,d) financing of a terrorist offence, referred to in art. 299 of the Penal Code,e) of a terrorist nature, referred to in Art. 115 § 20 of the Penal Code, or aiming at committing this offence,f) entrusting work to a minor foreigner, referred to in Art. 9.2 of the Act of 15 June 2012 on the results of employing foreigners unlawfully residing on the territory of the Republic of Poland (Dz. U. No. 769),g) an offence against economic turnover referred to in Article 296-307 of the Penal Code, an offence against fraud referred to in Article 286 of the Penal Code, an offence against credibility of documents referred to in Article 270-277d of the Penal Code or a fiscal offence,h) referred to in Article 9 sections 1 and 3 or Article 10 of the Act of 15 June 2012 2) if the incumbent member of its managing or supervisory body, a partner in a general partnership or partnership, a general partner in a limited partnership or a limited joint-stock partnership, or a proxy has been validly convicted of an offence referred to in item 1;3) against whom a final court judgement or a final administrative decision on default of payment of taxes, fees or contributions for social or health insurance was issued, unless the economic operator, respectively before the deadline for submission of requests to participate in the proceedings or before the deadline for submission of tenders, made the payment of due taxes, fees or contributions for social or health insurance together with interest or fines or concluded a binding agreement on payment of these receivables;4) who has been legally banned from competing for public contracts; 5) if the Awarding Entity can confirm, based on reliable grounds, that the economic operator entered into an agreement with other economic operators with the aim of distorting competition, in particular if they belong to the same group as defined in the Act of 16 February 2007 on competition and consumer protection and have submitted a report on competition and consumer protection 6) if, in the cases referred to in art. 85 sec. 1, there has been a distortion of competition resulting from previous involvement of that economic operator or an entity which belongs to the same capital group with the economic operator within the meaning of the act of 16 February 2007. on competition and consumer protection unless the distortion of competition caused by such action can be eliminated otherwise than by excluding the Economic Operator from participation in the procurement procedure, and the Economic Operator shall be excluded pursuant to provisions of Articles 110 and 111 of the PPL Act, as far as these provisions refer to obligatory exclusion grounds.2. meet the conditions for participation in the proceedings.
