Description

The subject of the contract is the delivery of a new multioperational forwarder machine, production year not older than 2019, with warranty and post-warranty service, consisting in the provision of repair and overhaul services and the provision of maintenance services.2 The subject of the contract is to be performed on the basis of a detailed description of the subject of the contract attached as Appendix No. 1 to the ToR.3.The required conditions of warranty, repair and overhaul during the warranty period and after the warranty period are included in point 3.3.3. SIWZ.4. The Contractor will provide training in accordance with the following conditions: a) theoretical training in operation and maintenance, current repairs and overhauls of the machine for a maximum of 8 employees with a minimum of 8 hours. The training shall take place at the Employer's seat or at the Contractor's service point during the term of the contract, at a time and place agreed with the Employer; b) practical training for the Employees of the Employer of the subject matter of the contract - in total at least 56 hours. The training will take place during the term of the contract within the time limit to be agreed with the Employer; c) the training should be completed with an examination and issuance of a certificate for the operators (Employees of the Employer); d) all costs related to the training of the Employer's employees (including travel, food, accommodation, spent fuel during the operation of the machine, possible transfer of machines) are covered by the Contractor.5 The Contractor will allow the Employer to install a GPS system allowing to determine the position of the machine and to obtain real-time information about the amount of fuel in the tanks and its current consumption without losing the right to a guarantee for the machine. The Contracting Authority, with its consent, allows the use of another alternative solution (e.g. a factory solution).6 The Contractor may entrust the execution of part of the order to a subcontractor. The Ordering Party does not reserve the obligation of personal execution of key parts of the order by the Contractor. In case of the intention to perform the subject of the contract with the participation of subcontractors, the Contractor is obliged to indicate in his offer: part of the contract (material scope), the performance of which he intends to entrust to subcontractors and subcontractors' companies. If the change or resignation of the subcontractor concerns the entity to whose resources the Economic Operator referred, pursuant to the principles set out in Article 22a(1) of the PPL, in order to prove the fulfilment of the conditions for participation in the procedure, the Economic Operator is obliged to prove to the Contracting Authority that the proposed other subcontractor or the Economic Operator fulfils them on its own, to the extent not less than the extent of the subcontractor to whose resources the Economic Operator referred during the procurement procedure.
