BVG, as the sector contracting authority, invites tenders for the calendar year 2023/2024 for rail replacement services (SEV) with buses provided by the AG in local public transport, which the contractor organizes and carries out independently. The invitation to tender shall be issued in two separate but equivalent lots. There is no lot restriction, i.e. a bidder can bid for one or two lots.2,000 hours of rail replacement services are required per month over a period of 10 months. There will be approx. 4 circulations per day with approx. 17 hours per circulation. The circulations start at approx. 05.00 o'clock and end at approx. 22.00 o'clock. Each round trip starts and ends at one of the AG's depots. In the performance period 01.02.2023 to 30.11.2023 and in the performance period 01.02.2024 to 30.11.2024, there will be approx. 20,000 operating hours in each case. The operating hours stated represent an approximate value. The Client shall call for at least 18,000 operating hours per year and no more than 22,000 operating hours per year, whereby the Contractor shall not be entitled to call for a minimum number of operating hours per month, but shall be entitled to remuneration for at least 18,000 operating hours per year (take-or-pay).The Client shall call for the driving performance to be provided in each case no later than 3 weeks in advance and shall specify the details of the driving performance at the same time. If the Principal is unable to use the Contractor's requested mileage for rail replacement services, in particular due to unforeseeable changes or internal operational processes, the Principal may also use the requested mileage for the Principal's regular services. In addition, a further maximum of 44,000 hours may be required (see Option II 2.11).The service will be put out to tender in two separate but equivalent quantity lots. There is no lot restriction, i.e. a bidder may bid for one or two lots. A bid for a lot is submitted in such a way that the bidder submits a bid for one of two (quantity) lots; there is no specific specification of a particular lot number. We draw the attention of the bidders to the fact that the forms of the AG deviate from this and provide for a determination of the lot number. Nevertheless, the AG will include the bid of a bidder entered in the bid form under lot number 1 in the evaluation for lot 2 if the bid was not considered in the result of the evaluation for lot 1, i.e. the bid is not intended for the award of lot 1.A bid for two lots is submitted in such a way that the bidder submits a bid for two of two (quantities) lots; here, too, there is no concrete specification of a specific lot number for one or the other bid. We would like to point out to the bidders that the forms of the AG deviate from this and provide for a determination of the lot number. Nevertheless, the AG will include the bid with the lower total price in the evaluation for Lot 1 (or, in the case of identical prices for both lots, the AG will consider one bid of the bidder in the evaluation of Lot 1). If this bid with the lower total price is not successful for lot 1, it will be included again in the evaluation for lot 2; in this case, the bid with the higher total price would not be included in the evaluation as a whole, i.e. neither in the evaluation for lot 1 nor for lot 2. If the bid with the lower total price (or, in case of identical prices, the evaluated bid) is successful for lot 1, the bidder's further bid will be included in the evaluation for lot 2.
