Description

Renewal of a framework agreement for the handling of the purchase of Adobe software on the basis of an existing ETLA contract for a period of 3 years.
The City of Bochum, Office of Human Resources Management, Information Technology and Organization, Division 11 IT, has entered into an ETLA contract with Adobe Systems Software Ireland Limited (ADIR) 4-6 Riverwalk, Citywest Business Campus, Saggart, Dublin 24, Ireland under contract number 00828226 for Adobe On-premise Software (Feature Restricted - Online) for a term of two years, commencing on November 29, 2020. During the term of the contract, Premiere Elements, Premiere Pro, and After Effects products were added to the contract. This contract is to be renewed for a term of three years with a purchase start date of 11/29/2022 (see Attachment 1, draft contract "ETLA for Stadt Bochum_00901044.0_Draft_20220627.pdf") and a commercial partner is to be found for this purpose. The volume includes a planned maximum of 480,000.00EUR gross over the 36 months for initial order and TrueUps. If, contrary to expectations, this volume is not sufficient, a contract extension can be made, which must then be re-budgeted.We are looking for a reseller authorized by Adobe, with whom a framework agreement is to be concluded for the handling of the purchase of Adobe on-premise software on the basis of the named ETLA contract (current scope and details see named attachments). The term of the framework agreement shall be based on the term of the ETLA agreement. The reseller authorized by Adobe shall offer the designated software licenses for the entire term of the agreement and shall be available to the organization "City of Bochum" with regard to all questions concerning the agreement with service and support in German and/or English and shall also offer and provide future requirements for software licenses on the basis of the ETLA agreement (true-up pricing).The pro-rata discount offered by the Bidder for the Adobe Initial Price must be equal to the discount offered for Adobe True-Up Licenses (i.e., identical in percentage for Initial Price orders as well as for future True-Up orders per software product). The calculated demand figures may vary upward until the start of the contract due to demand that has arisen in the meantime.N o t eThe award will only be made to an Adobe-authorized ETLA reseller with Gold or Platinum status who is already active in the Government business unit. Proof of the bidder's authorization by Adobe as an ETLA reseller must be included with the bid. At least one reference customer, preferably with a German or English-speaking contact person, must be named as proof of activity in the Government business unit.
