Security for the performance of the contract is to be provided in the amount of 5.0 per cent of the contract sum (incl. value added tax, without supplements), provided that the contract sum amounts to at least 250,000 Euro without value added tax.The security to be provided for claims for defects is 3.0 per cent of the settlement sum (incl. value added tax) including supplements issued. Return date for unused security for defect claims (§ 17 Para. 8 No. 2 VOB/B): 4 yearsContractual penalties (§ 11 VOB/B)The Contractor shall pay the following as a contractual penalty for each working day of delay if the specified individual deadlines or the deadline for completion are exceeded: 0.5 per cent of the contract sum stated in the order letter excluding VAT; amounts for maintenance services offered shall not be taken into account. The reference figure for calculating the contractual penalty in the event that individual deadlines agreed as contractual deadlines are exceeded shall be that part of this order sum which corresponds to the services to be performed under the contract up to that point in time. The contractual penalty shall be limited to a total of 5.0 per cent of the contract sum stated in the order letter (excluding value added tax).Contractual Penalty (Section 18 HVTG)For each culpable breach of an obligation arising from the declaration of commitment to tariff compliance and minimum wages, the Contractor shall pay a contractual penalty amounting to one per cent of the net contract sum.
