Description

The seaport of Brake, operated by Niedersachsen Ports, is a modern multifunctional special port on the Weser, 26 kilometres above the estuary of the river Weser. The water depths of the outer and lower Weser allow a maximum ship draught of up to 11.90 m to Brake depending on the tide; an adjustment to 12.80 m is planned. The port facilities of the Brake seaport extend over a length of almost 2 km parallel to the river Weser. Efficient handling facilities and storage areas for general cargo and bulk goods are provided here. In addition, a further 450 m quay with 2 berths for ships was put into operation to the north (Niedersachsenkai). Heavy goods (in particular iron and offshore plants) can also be handled here. The seaport of Brake is connected to the European transport network by the federal roads 212 and 211 (1 km distance) and the motorway BAB 27 (5 km distance). Niedersachsen Ports is located in the area of the inland port belonging to the seaport of Brake, the site B12 with a size of 1 141 m2 from 1.4.Until 31.3.2025, the property will be used in such a way that the current holder of the heritable building right will operate a fish restaurant/a fish hall with an attached winter garden (gastronomy incl. fish marketing) on the property. This building is in the ownership of the current leaseholder. The fish marketed here will be transhipped via the seaport of Brake, among other places, and in future the property will continue to be used for gastronomic purposes with an affinity to the port. in order to ensure that the valuable building located on the property can be used for as many purposes as possible, this award procedure will make it possible for the future hereditary building right holder to continue to operate the fish hall together with the restaurant winter garden.The current leaseholder has undertaken to negotiate with the successful bidder in the present award procedure about the takeover of the existing buildings at their market value. In the case of a takeover of the buildings and facilities, an earlier handover date may be negotiable. For the sake of good order, it is clarified that Niedersachsen Ports is not liable for the condition and/or fitness for use of the buildings and installations. The current leaseholder is also entitled to apply for subsequent use within the framework of the invitation to tender, as the bidders will be able to inspect the building in detail in coordination with the current leaseholder. Against this background, Niedersachsen Ports is carrying out this negotiation procedure for the use of the B12 property for the aforementioned port-related purpose (fish gastronomy/marketing) by concluding a leasehold agreement (with an obligation to use the property for the relevant port-related purpose and to erect buildings and facilities or to take over the existing buildings into the ownership of the leaseholder and put them into operation).
