G.I.B. mbH is looking for specialist lawyers for labour law to set up a legal advice pool to provide freelance support to the advisers of the advice centres Arbeit NRW in labour law advice.The subject of the open house procedure is the conclusion of "non-exclusive consultancy contracts". The legal advice pool starts on 15.12.2021 and is initially limited until 31.12.2022.
A) SCOPE OF SERVICESThe G.I.B. mbH is looking for specialist lawyers for labour law to set up a legal advice pool to provide freelance support to the advisers of the Bera-tungsstellen Arbeit NRW in labour law consultations.The subject of the open house procedure is the conclusion of "non-exclusive consultancy contracts". The legal advice pool will start on 15.12.2021 and is initially limited until 31.12.2022. Subject to uniform contract conditions and a uniform fee as well as a uniform access procedure, all suitable and interested applicants will be offered the opportunity to conclude or join the contract at any time during the entire defined contract period. The open house procedure provides for the specification of uniform contract conditions for the participants in the procedure. The contract conditions and uniform commission fees are therefore non-negotiable and identical for all contracting parties. The contract ends on 31.12.2022 at the latest, irrespective of the date of the conclusion of the contract.According to the case law of the ECJ, this does not constitute the award of public contracts within the meaning of Directive 2014/24/EU of the European Parliament and of the Council or Sections 97 et seq. GWB. Rather, according to the case law of the ECJ, so-called open house procedures are not subject to public procurement law, as no competition takes place due to the lack of a selection decision. In order to ensure the greatest possible degree of transparency for the intended conclusion of contracts, the service which is the subject of this contract is nevertheless published in the Supplement to the Official Journal of the European Union. The contracting authority does not make a selection decision and submits an identical contract offer to each interested company which meets the requirements for inclusion in the pool. Provided the applicant meets the requirements for inclusion in the pool, the provider is included in the list of potential consultants of Beratungsstellen Arbeit NRW. The final selection decision for a counsellor is made by the user and not by the client.B) TARGET GROUPTarget group are the counsellors of the 53 counselling centres Arbeit in NRW. The counselling centres for work advise unemployed people and people threatened by unemployment, people returning to work, employees with supplementary SGB II benefits and people affected by labour exploitation. The facilities provide support in social and labour law matters as well as in economic and psychosocial issues. They offer individual case-related counselling on career development and provide information on qualification and employment opportunities. As pilots, they provide access to further assistance and counselling services. In addition, they are a central building block in the network against labour exploitation in North Rhine-Westphalia.C) CONTENT AND SUPPORTING FORMS Counsellors at the Employment Counselling Centres should be given the opportunity to consult the specialist lawyers for labour law listed in the legal advice pool as part of their own counselling if further extrajudicial legal advice on labour law issues is necessary and desired by those seeking advice. In addition, the counselling centres should be able to draw on the specialist knowledge of specialist lawyers to provide legal support for their counselling, even if they are not directly involved in the counselling. In principle, it is also possible to call in the accredited specialist lawyers to conduct information events or group consultations.D) NUMBER AND DURATION OF CONSULTATIONSThe individual enquiry is made by the counsellors of the counselling centres work within the framework of the respective budget made available by the G.I.B. This also applies to the duration of the case-related support as well as any participation in information events or group counselling sessions.E) PROCEDUREThis announcement concerns an open house procedure. The aim of this procedure is to identify suitable companies for inclusion in the consultancy pool, with the result that the legal requirements for the implementation of an award procedure pursuant to Sections 97 et seq. GWB or the EU Directive 2014/24/EU of the European Parliament and of the Council do not apply directly.
