Object of the contract: The object of the contract is the operation of the shared accommodation for asylum seekers and refugees at the location Theodor-Echtermeyer-Weg 2 in 14979 Großbeeren.2 Contract term: The contract begins on 01.12.2024 and has a term of 24 months. It therefore regularly ends on 30.11.2026, after which the client has the option to extend the contract for up to a further 6 months at the terms of the offer. The client must exercise the option by midnight on 15.08.2026 at the latest and the takeover of operation (key authority) will take place on 29.11.2024 at 11.00 am. In accordance with existing contractual provisions, the transfer of responsibility (transfer of risk) shall take place on 01.12.2024 at midnight. 3. scope of service: In accordance with Section 1 (1) of the State Reception Act (LaufnG), the reception and temporary accommodation of ethnic German repatriates and foreign refugees as well as the implementation of the Asylum Seekers' Benefits Act (AsylbLG) are public tasks that are assigned to the districts and independent cities as a mandatory task to be fulfilled in accordance with instructions. The reception obligation extends to all groups of persons in accordance with § 2 LAufnG. As long as it is not possible to provide accommodation outside the shared accommodation, usually with living space, the persons are to be temporarily accommodated in temporary accommodation facilities in accordance with § 2 LAufnG (§ 4 Paragraph 1 LAufnG). The district of Teltow-Fläming is obliged to set up and maintain the necessary temporary accommodation facilities (temporary hostels and temporary apartments) and to guarantee the care of the group of people specified in § 2 LAufnG (§ 4 Paragraph 2 LAufnG).Pursuant to Section 1 (3) LAufnG, the administrative districts, independent cities as well as the local authorities and independent municipalities work in consultation with the other providers of integration measures and assistance to ensure the swift provision of housing and other integration measures for the group of persons specified in Section 2 (1) and (2) LAufnG as part of their self-administration duties. Pursuant to Section 4 (3) LAufnG, the administrative districts and independent cities can also commission third parties with the operation of transitional accommodation and the care and social counseling of persons pursuant to Section 2 LAufnG.The administrative district of Teltow-Fläming provides a building in the municipality of Großbeeren for the central accommodation of asylum seekers and refugees for communal accommodation. The building is divided into units of two rooms each with their own bathroom and kitchenette, so that the accommodation is equivalent to a housing association. The corridors, stairs, laundry room and common room are shared. Up to 220 people can be accommodated in the building in accordance with the provisions of § 11 and Annex 3 of the Implementation Ordinance to the State Reception Act (LAufnGDV). The building will be provided by the district of Teltow-Fläming to the standard required in accordance with § 11 and Annex 3 of the Implementing Ordinance to the State Reception Act (LAufnGDV) and is fully equipped with the necessary furniture. The service includes the following partial services in particular: a. Operation of the shared accommodation, in particular - Management and administration of the shared accommodation - Ongoing maintenance of the buildings and furnishings, including repairs and replacement equipment in accordance with the rental agreement, including regular routine pest control at least quarterly and ongoing monitoring - Commissioning of maintenance and security inspection services as required - Enforcement of order and security in the shared accommodation - Enforcement of move-out management - Offering, implementation and monitoring of community service work by residents, whereby at least 5% of residents must be employed in such work. The paid services for this offer are borne by the district of Teltow-Fläming (payment to residents)b. Accommodation for asylum seekers and refugees assigned by the district of Teltow-Flämingec. Social counseling and support of the assigned persons (8 hours from Monday to Friday, except public holidays, between 8:30 a.m. and 5:30 p.m., flexibility within the framework possible)d. Guarding and securing the shared accommodation in accordance with the specified scope by an experienced and suitable security companye. Creation and maintenance of a security and violence protection conceptf. Regular cleaning of the building, glass and, if necessary, laundry as maintenance cleaning, care of the outdoor area, including winter service if necessary4. Quality of the service: a. OperationFor the operation of the shared accommodation and the counseling and care of the assigned asylum seekers and foreign refugees from various countries, the minimum conditions for the operation of shared accommodation and social care in accordance with the reimbursement ordinance to the State Reception Act in the current version represent the legally binding basis of the minimum necessary quality standard. For the counseling and support of asylum seekers and refugees, the operator shall provide sufficient suitable specialist staff in accordance with the requirements of the minimum conditions for the operation of shared accommodation and social support in the current version of the Reimbursement Ordinance to the State Reception Act. This specialist staff must be fluent in German (at least C1, if not a native speaker) and have a good knowledge of English as well as advanced basic knowledge of at least one other foreign language and the ability to empathize and be sensitive enough to provide support in accordance with the principles of social work. The staff is also responsible for ensuring the care of the residents if this cannot be ensured by the residents themselves due to an official measure, and the operator ensures the ongoing operation and organizational management of the shared accommodation by other suitable staff. The operator has relevant experience with temporary accommodation facilities from at least three occupied reference properties.The operator provides a wireless network (WLAN) in the facility, which can be used by the residents free of charge.The operator is also responsible for securing the security of the facility and uses a suitable security company for this purpose. As part of the tasks assigned to it, the operator acts as a partner in the local specialist networks and comprehensively integrates the shared accommodation for asylum seekers and refugees into the existing community structures through broad socio-spatial approaches on site.b. SecurityThe security company has appropriate experience with shared accommodation from at least three proven reference objects.1.) Scope:In accordance with the current security concept for the shared accommodation, guarding and security is ensured to the following extent:A security guard is on duty every day from midnight to midnight, i.e. 24 hours a day on all days of the week.A second member of staff provides backup during times when no member of the migration social work team is on site.In addition to the pure guarding tasks, the staff deployed are the first point of contact for urgent problems of asylum seekers and foreign refugees during the times when the social workers working on site are absent. It also supports care measures in exceptional situations.2.) Quality:The shared accommodation is a guarded property with high security-specific requirements. The security company therefore already has experience of guarding and securing temporary accommodation facilities for asylum seekers and refugees in at least three reference properties and can provide evidence of this experience.Cooperation with the local regulatory authorities and the police is not a new challenge for the security company deployed. The security company has suitable and experienced personnel available for this purpose. The operator ensures that the staff employed are paid in accordance with the provisions of the Brandenburg Public Procurement Act and provides evidence of this on request. He also monitors that the personnel fulfill the requirements for performing the task. In addition, the security company shall draw up a new security concept and a concept for the protection against violence and shall actively participate in the further development of these concepts within the scope of the contract The bidder shall draw up a brief concept of no more than 20 pages (Arial, font size 11, margins set to "normal", top, left and right margins 2.5 cm, bottom 2 cm) for guarding the property. This concept does not have to be available when the tender is submitted, but at the latest four weeks after taking over the operation, including confirmation from the regulatory authorities. With regard to the residents of the shared accommodation (asylum seekers and refugees from different countries), the tenderer shall ensure the provision of suitable and experienced personnel who are paid in accordance with the attached agreement on compliance with the minimum requirements under the Brandenburg Public Procurement Act and who are fluent in written and spoken German.The security staff deployed will actively exercise domiciliary rights and enforce the existing house rules when the social workers in the shared accommodation are absent. The staff patrol the property at least once an hour, which is documented for the client and the district of Teltow-Fläming using an electronic recording system. The district of Teltow-Fläming is provided with rosters as well as the documents for the security check in accordance with § 34a GewO and employment contract documents to monitor the collectively agreed remuneration.4Pricing: The price for the operation of the shared accommodation is offered in the form of a basic flat rate for the occupancy-independent operation and a cost rate per asylum seeker or refugee accommodated per month. the necessary rental costs, the operating costs within the meaning of the operating cost allocation ordinance are borne by the district of Teltow-Fläming.All other costs incurred, in particular but not limited to the costs for necessary replacement purchases and repairs of the inventory provided by the district, the costs for value maintenance, cosmetic repairs and repairs as a result of improper use or damage, the costs for cleaning the common rooms and areas as well as the outdoor facilities, any necessary pest control, general material and administrative costs, the necessary qualified security and all other necessary operating expenses are included in these cost rates. The disposal of scrap and bulky waste as well as the clearing of the property of inventory and property of the residents and third parties are also carried out at the behest and expense of the contractor. The basic flat rate and the occupancy-dependent cost rates cover all expenses incurred by the owner for the performance of the assigned tasks in the required quality.
