Description

1 The subject matter of the contract are medical equipment maintenance services at Copernicus PL Sp. z o.o. in Gdańsk. The scope of the contract covers 7 parts:-Part no. 1 - Servicing of equipment manufactured by GE Healthcare and Datex-Ohmeda,-Part no. 2 - Servicing of equipment manufactured by Valleylab, Mallinckrodt, Somanetics, Airox, Puritan Bennett, Newport Medical Instruments, Aspect Medical Systems, Medtronic,-Part no. 3 - Servicing of equipment manufactured by Maquet Maquet,-Part no. 4 - Servicing of equipment manufactured by Maquet and Datex-Ohmeda. Lot no. 4 - Servicing of equipment manufactured by Maquet,- Lot no. 5 - Servicing of equipment manufactured by Olympus,- Lot no. 6 - Servicing of equipment manufactured by Storz,- Lot no. 7 - Servicing of equipment manufactured by GE Healthcare. The subject matter of the contract shall be performed according to the provisions of draft agreement - appendix no. 3 to the SWZ (Terms of Reference) and according to the Schedule, which constitutes appendix no. 2 to the agreement.
1.The subject matter of the contract is the maintenance of medical equipment (GE Healthcare and Datex-Ohmeda equipment) at Copernicus PL Sp. z o.o. in Gdańsk. A detailed list of equipment to be serviced is contained in appendix no. 1 to the SWZ - Price Form. The subject matter of the contract should be performed in accordance with the provisions of the draft agreement- appendix no. 3 to SWZ and in accordance with the Schedule, which constitutes appendix no. 2 to the agreement.2.It is required that the Contractor is included in the list of entities referred to in Article 90 of the Act of 20 May 2010 on medical devices (Journal of Laws 2020, item 186 of 13 December 2019), and the persons directed to perform the agreement must have the qualifications specified by the manufacturer of medical devices. Pursuant to the provisions of § 6 item 1 of appendix no. 3 to SWZ (Draft Contract), the Ordering Party requires the Contractor to intervene, alternatively called the response to the reported repair, within a maximum of 2 working days from the date of receipt of notification from the Ordering Party. Response to reported repair is one of the bid evaluation criteria.5.Pursuant to Article 95(1) of the PPL Act, the Contracting Authority requires that the Contractor or a subcontractor employ, on the basis of an employment contract within the meaning of the Labour Code Act of 26 June 1974 (Journal of Laws of 2019, item 1040, 1043 and 1495), continuously throughout the term of the Contract, a person/people performing activities related to the performance of the subject matter of the contract.6.The Contracting Authority does not reserve the possibility for Economic Operators referred to in art. 94 of the PPL Act to compete for the contract.7.In connection with the performance of the contract the Contracting Authority does not provide for the obligation of personal performance of key tasks of the contract. 1.The contract covers servicing of medical equipment (equipment manufactured by Valleylab, Mallinckrodt, Somanetics, Airox, Puritan Bennett, Newport Medical Instruments, Aspect Medical Systems, Medtronic) at Copernicus PL Sp. z o.o. in Gdańsk.
