Description

3.1 The subject matter of the contract is successive delivery of single-use fluids and consumables for continuous renal replacement therapy using veno-venous haemodialysis, together with lease to the Ordering Party of 6 units of continuous renal replacement therapy units (CVVHD) for adults. The subject matter of the contract has been described and detailed in Appendix 2, Price Form. 3.2. The Ordering Party requires delivery of renal replacement therapy units within 14 days from the date of signing the contract. 3.3. Full compatibility is understood as full utilisation of therapeutic capabilities of the offered devices combined with full utilisation of therapeutic capabilities of fluids and consumables and 100% compatibility of their therapeutic technology.3.4.

The Ordering Party requires delivery of renal replacement therapy units within 14 days from the date of signing the contract. 3.3. Full compatibility is understood as full utilization of the therapeutic capabilities of the offered apparatuses combined with full utilization of the therapeutic capabilities of the fluids and consumables and 100% compatibility of their therapeutic technology.3.4.The Purchaser requires the completion of the CRRT Bid Calculator (net and gross) 3.5.The place of delivery of the apparatuses is the SPZOZ ICU, while the consumables is the medical warehouse of the hospital pharmacy in Łęczna. CPV code 33181000-2-Renal therapy devices, 33181510-0-Renal therapy fluids; 3.6. All the items listed should be offered as per the therapy protocol presented.3.7. The technical parameters given in the attachments should be considered as a template to meet the minimum requirements. If a trade name of a company, commodity or product is indicated in the tender documentation, the Contracting Authority shall accept equivalent solutions which comply with the technical data and parameters included in the documentation. If the Contracting Authority allows solutions equivalent to those described in the documentation constituting an appendix to the ToR, but does not provide the minimum parameters that would confirm such equivalence - the Economic Operator is obliged to offer a product with similar properties, functionally suitable for the required application (argument based on the ruling of the National Appeal Chamber of 14 October 2013 [ref. [ref. no.: KIO 2315/13]). The Contractor who invokes equivalent solutions described by the Contracting Authority is obliged to prove that the supplies offered by him meet the requirements specified by the Contracting Authority. NOTE: A proper name is a name under which the object it denotes exists (or would exist) both in Poland and in other countries.3.9. Whenever trademarks, patents, origin, standards, approvals, technical specifications and technical reference systems are indicated in the description of the subject matter of a contract, the Contracting Authority shall accept equivalent solutions. Equivalence shall consist in the possibility to offer the subject matter of the contract with no worse technical parameters, configurations, normative requirements, etc.3.10. The subject matter of the contract shall be new, authorised to be placed on the market pursuant to the applicable provisions of law and shall meet all requirements defined by the provisions of law, in particular the Act of 20 May 2010 on medical devices (Journal of Laws of 2020, item 186) and shall be free of any physical or legal defects.3.11. The costs of consumables underestimated in the bid shall be borne by the Contractor.3.12. The Contractor shall be obliged to train 60 persons in the operation of the offered apparatus. The trainings shall take place at the Purchaser's seat and shall be divided into 3 days, 5 hours each. 3.13. The payment period shall be up to 60 days from the date of receiving a correctly issued invoice.3.14. Information on prior evaluation of offers, pursuant to Article 139 of PPL. The selection of the most advantageous offer will be made using the so called "reverse procedure". The Contracting Authority shall first examine and evaluate the tenders and then qualify the contractors whose tenders were evaluated most favourably with respect to absence of grounds for exclusion and meeting the conditions for participation in the procedure.
