Description

The subject of the order is the delivery of disks and licenses to expand the data storage environment based on 2 Huawei OceanStor 2600 V3 disk arrays in accordance with the rules set out in the ToR. The delivery will be made in accordance with the rules set out in the ToR, including the "description of the subject of the order" form and the model contract. Right of option: In addition to the guaranteed order, which includes the delivery of a license for remote synchronous data replication between two Huawei OceanStor 2600 V3 matrices (1 unit / matrix) and 12 units of SAS SSD 3.84 TB, the Ordering Party reserves the right to execute the order covered by the option right. Exercising the right of option will consist in delivering 8 discs indicated by the Orderer, i.e: (4 pieces of 3.84 TB 2.5 SAS SSD and 4 pieces of 3.84 TB 3.5 SAS SSD). Description of the elements covered by the right of option is included in the form "description of the subject of the order".

Exercising the right of option will consist in delivering 8 discs indicated by the Orderer, i.e: (4 pieces of 3.84 TB 2.5 SAS SSD and 4 pieces of 3.84 TB 3.5 SAS SSD). Description of elements covered by the right of option is included in the form "description of the subject of the contract". Within 40 days counting from the date of concluding the contract, the Ordering Party shall provide the Contractor with written information about the use or non-use of the right of option. In the information on exercising the option right the Awarding Entity shall indicate to what extent, i.e. what number of elements they wish to use. Delivery date of the elements ordered under the right of option: up to 30 days from the date of receipt of written information on exercising the right of option. The exercise of the option right will depend on the Orderer's decision (in particular on the Orderer's possession of funds in an appropriate amount). The Contractor shall not be entitled to any claims against the Contracting Authority in the event of failure to exercise the option right or in the event of incomplete exercise of the option right.The above mentioned execution periods shall apply subject to the provisions of § 3 and 4 of the model contract. Note: The Contracting Authority reserves that the contract should be concluded by 31 December 2020. In principle, concluding an agreement after this date is not possible due to the financing of tasks covered by the contract from the NFZ investment plan for 2020. In accordance with the regulations in force at the NFZ, the condition for financing tasks from the 2020 plan is to conclude an agreement (contract award) by 31 December 2020. A detailed description of the subject matter of the contract is contained in the "description of the subject matter of the contract" form, which is an integral part of the ToR.5 The contract shall be performed under the terms and conditions specified in the model agreement, which is an integral part of the ToR. The model agreement also provides for and defines the conditions of a possible change in the content of the agreement.6 The Economic Operator shall provide the name of the manufacturer, capacity and model name of the offered elements in the "description of the subject matter of the contract" form. The "description of the subject matter of the contract" form, including the names of the manufacturer, capacity and model names indicated by the Economic Operator, shall constitute the content of the offer.7Order completion date: a) performance of a guaranteed order - within 60 days from the date of concluding the agreement, not later than 20 January 2021; performance of an order covered by the option right - within 30 days from the date of receiving information on exercising the option right, not later than 20 January 2021; b) if the Ordering Party exercises the option right, the Ordering Party shall provide the Contractor with written information on exercising or not exercising the option right within 40 days from concluding the agreement. In the information on exercising the option right, the Contracting Authority shall indicate to what extent, i.e. what number of elements it wants to use. The Contractor shall deliver the item covered by the option right within 30 days from the date of receipt of written information on exercising the option right, not later than 20 January 2021.
