Nature of Requirements:

1. Advance Contract Award Notice (ACAN)

An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.

2. Definition of the requirement

Environment Canada has a requirement for the supply, delivery, installation of Q-Exactive High Resolution Mass Spectrometer with a Vanquish Flex, Ultra Performance Liquid Chromatograph (UPLC-Q-Exactive-HRMS) Instrument System for delivery in Ottawa and used in the OCRL (EWHD, WLSD) for the discovery and determination of unique environmental pollutants in environmental samples of biota, wildlife and other media including training, the Standard One Year Warranty and Support Services and Extended Warranty and Support Services for three additional one (1) year periods. Environment Canada has identified the Q-Exactive High Resolution Mass Spectrometer with a Vanquish Flex, Ultra Performance Liquid Chromatograph (UPLC-Q-Exactive-HRMS) Instrument System from Thermo Fisher Scientific, Mississauga, Ontario as the only system that meets all of the minimum essential requirements.

3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)

Any interested supplier must demonstrate by way of a statement of capabilities that its instrument meets the following requirements:

a) The UPLC(VF)-Q Exactive-HRMS instrument system possesses unique Orbitrap HRMS technology.

b) The UPLC(VF)-Q Exactive-HRMS is a patented new generation instrument system only offered by Thermo Fisher, which combines quadrupole and C-trap-orbitrap mass analyzer technologies together. This provides the necessary HRMS to separate chemical interferences to facilitate the identification of unknown compounds in complex environmental matrices while providing similar or better quantitative performance than triple-quadrupole LC-MS / MS for quantitative analysis of known targeted compounds.

c) The C-trap technology that is used in the Q Exactive-HRMS makes the instrument easy to use and very stable, which is unmatched by any other benchtop technology currently available on the market.

d) The UPLC(VF)-Q Exactive-HRMS offers a mass spectral resolving power of up to 140,000 for small molecules; chemical environment pollutants (and their metabolites) are in this small molecule range. There is no alternative vendor that can offer such high resolution for small mass molecules.

e) The UPLC(VF)-Q Exactive-HRMS has high precision on the exact measurement of masses (~1ppm internal calibration / ~ 3ppm external) and it is essential to the determination of the elementary formula of unknown chemicals in environmental samples. This is an essential asset in the identification of unknown contaminants.

4. Applicability of the trade agreement(s) to the procurement

This procurement is subject to the following trade agreement(s):

a. Canadian Free Trade Agreement (CFTA)
b. North American Free Trade Agreement (NAFTA)
c. World Trade Organization - Agreement on Government Procurement (WTO-AGP)

5. Justification for the Pre-Identified Supplier

The only known supplier that can deliver the Vanquish Flex Ultra Performance Liquid Chromatography- Q Exactive High Resolution Mass Spectrometry (UPLC(VF)-Q Exactive-HRMS) instrument system meeting all required technical specifications is the Vanquish Flex Ultra Performance Liquid Chromatography- Q Exactive High Resolution Mass Spectrometry (UPLC(VF)-Q Exactive-HRMS) instrument system from Thermo Fisher Scientific of Mississauga, Ontario.

The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

11. Closing date for a submission of a statement of capabilities

The closing date and time for accepting statements of capabilities is December 2, 2019 at 2:00 p.m. EST.

An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award. However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.

Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.

The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.

The Crown retains the right to negotiate with suppliers on any procurement.

Documents may be submitted in either official language of Canada.
