Description

The general objective of this assignment is to conclude a framework contract with a service provider for provision of interim personnel to EFCA in accordance with the specifications and performance terms described in the tender specifications and in the framework contract. The contractor shall provide EFCA with the necessary interim personnel in a timely fashion and in line with the profiles requested. The profiles for which EFCA might request interim personnel in the context of this contract include the profiles of Administrative Assistant in the areas of EFCA activities, i.e. of the operational units as well as the horizontal services in the areas administration, HR, legal and financial management.
EFCA may need the services of interim personnel, as a complement to its statutory staff, to perform work of a temporary nature• to replace statutory staff temporarily absent due to maternity leave, sickness or other reasons;• to cope with peak periods which require an additional workforce for a fixed period of time;• to perform work in connection with a specific project.The contractor must apply to the interim personnel the applicable Spanish social and labour legislation provisions in force, it being understood that the provision of interim personnel to EFCA shall in no way lead to an employment relationship between said interim personnel and EFCA and hence the regulations applicable specifically to EFCA statutory staff (Staff Regulations of Officials of the European Communities) shall not apply to the interim personnel. The contractor undertakes to comply with all applicable legislative and regulatory provisions in force locally, notably but not limited to the areas of social security, health and safety, pension contributions and labour and tax legislation.For the avoidance of doubt, it is to be pointed out that interim personnel:(a) shall not have any direct contractual relationship with EFCA;(b) will not have power to represent or commit EFCA; nor(c) will not be allowed to manage EFCA statutory staff directly.
