The participating health insurance funds pursue the goal of concluding discount agreements with all suitable pharmaceutical companies in accordance with § 130a para. 8 SGB V for the active ingredient Fluticasone /Vilanterol (combination of active ingredients). The contract is concluded within the framework of the open-house original procedure of the health insurance companies:Individual negotiations on the contents of the contract are not conducted, uniform conditions apply. The health insurance companies do not guarantee exclusivity to individual contractual partners. The term of the contract is a maximum of 24 months starting on 1.10.2020. The contract ends on 30.9.2022 at the latest, regardless of the date of conclusion of the contract. All further information can be found in the participation and contract documents. If the patent expires before 30.9.2022, the contract ends automatically at the end of the month in which the patent expires.
It is possible to join this open-house original procedure at any time during the contract period. Due to the existence of industrial property rights with regard to the active substance covered by the contract, the participation and contract documents are only made available to pharmaceutical companies which offer/circulate medicines for the active substance covered by the process or which can provide evidence to TK that they intend to offer/circulate medicines for the active substance covered by the process within the contract period.A contract shall be concluded with all pharmaceutical companies which meet the requirements set out in Annex 4 to the contract (self-declaration of approval and company) and confirm this in electronic form pursuant to § 126a BGB (German Civil Code).this announcement does not concern the award of a public contract within the meaning of the Public Procurement Directive (2014/24/EC) or the Cartel Procurement Act. In the interest of the widest possible information of interested pharmaceutical entrepreneurs, this announcement is published in the Supplement to the Official Journal of the European Union. The procedural designation "Open procedure" used in the context of the present notice text in accordance with section IV.1.1. and the indication of the award criteria in accordance with section II.2.5. are due to the specifications of the notice form and have no further significance. Neither this nor the use of the "TED" medium is associated in any way with submission to regulations under public procurement law, the validity of which is not mandatory by law or award regulations.
