The subject of this order is the purchase of electricity, in accordance with the provisions of the Act of 10.4.1997 Energy Law (hereinafter: EP) by the Ordering Party to its lighting infrastructure (in accordance with their powers), in which the Ordering Party is a party to the distribution agreement. This order does not include electricity distribution services. The quality parameters of electricity are specified in the Ordinance of the Minister of Economy of 4.5.2007 on detailed conditions for the operation of the power system.2. A detailed description of the subject matter of the order, including locations and description of the street lighting and other electric power collection points, together with the contractual capacity and estimated consumption, is contained in Appendix 1 to the ToR, which constitutes an integral part of the ToR.
The subject matter of the contract is the purchase of electricity, in accordance with the provisions of the Act of 10.4.1997 Energy Law (hereinafter: EP) by the Ordering Party to its lighting infrastructure (in accordance with their powers), in which the Ordering Party is a party to the distribution agreement. This order does not include electricity distribution services. The quality parameters of electricity are specified in the Ordinance of the Minister of Economy of 4.5.2007 on detailed conditions for the operation of the power system.2 The subject matter of the order includes the purchase of electricity for the Contracting Authority's facilities listed in Appendix 1 to the ToR. A detailed description of the subject matter of the contract, including locations and description of street lighting and other electric power collection points, together with the contracted capacity and estimated consumption, is contained in Annex 1 to the ToR and in the model contract which constitutes Annex 6 to the ToR. 3. The Awarding Entity informs that: - as a result of concluding new distribution service contracts or situations economically justified for the Awarding Entity, some of the parameters listed in Annex 1 may change. Such situation may concern the contracted capacity or tariff (technical reasons). The estimated consumption of electricity from Annex 1 has been made with due diligence, however, it is indicative in nature, - for the connection points listed in Annex 1, the role of the Distribution System Operator (hereinafter: DSO) is played by the company: Energa Operator S.A.4. The Contractor must have a concluded and binding agreement, the so-called General Distribution Agreement, with a local DSO, on the basis of which it may sell electricity through the distribution network of this DSO to all facilities of the Ordering Party indicated in Appendix No. 1 to the ToR. The Contracting Authority states that for the points indicated in Annex 1 to the ToR, the role of the DSO is to be performed: Energa Operator S.A. In order to calculate the bid price, the Economic Operator should take into account the energy consumption indicated in annex no. 1 to the ToR, section 11. The Contracting Authority states that in order to avoid possible accounting errors when preparing a bid, it includes in annex no. 1 "Detailed description of the subject matter of the contract" "Summary list of energy consumption (data for calculating the contract value and the bid price)".5. The Contracting Authority does not provide for the requirements referred to in art. 29 par. 4 of the ToR and does not raise objections referred to in art. 36a par. 2 of the Act.6The Awarding Entity will apply the reversed procedure pursuant to art. 24aa of the PPL.
