The subject of this order is the supply of electricity to the facilities listed in Appendix 1 to the SWZ - description of the subject of the order. The demand for electricity in the period from 01.04.2023 to 31.12.2023 maximum is: 1,703,873 kWh. The detailed scope of the order is specified in Appendix No. 1 to the SWZ, in accordance with the provisions of the Energy Law of April 10, 1997. Other terms and conditions for the execution of the order are set forth in the draft provisions of the electricity sales agreement - Appendix No. 2 to the SWZ. Electricity will be supplied in accordance with the provisions of the Act of April 10, 1997. - Energy Law and in accordance with the implementing regulations issued to this Act, in particular, with the standards of customer service quality set forth in the Ordinance of the Minister of Energy of March 6, 2019 on the detailed rules for shaping and calculating tariffs and settlements.
(1) The subject of this order is the supply of electricity to the facilities listed in Appendix 1 to the SWZ - description of the subject of the order. The demand for electricity in the period from 01.04.2023 to 31.12.2023 maximum is: 1,703,873 kWh.2. The detailed scope of the order is specified in Appendix No. 1 to the SWZ, in accordance with the provisions of the Energy Law of April 10, 1997. Other terms and conditions for the execution of the order are set forth in the draft provisions of the power sales agreement - Appendix No. 2 to the SWZ.3. Electricity will be supplied under the terms and conditions set forth in the provisions of the Act of April 10, 1997. - Energy Law and in accordance with the implementing regulations issued to this Law, in particular, with the standards of quality of service to customers specified in the Decree of the Minister of Energy of March 6, 2019 on the detailed rules for the formation and calculation of tariffs and settlements in electricity trading. Electricity quality parameters in the distribution part are regulated by the Regulation of the Minister of Economy of May 4, 2007 on detailed conditions for the operation of the electric power system. (4) Distribution services will be provided on the basis of a separate agreement concluded by the ordering party with the relevant Distribution System Operator (referred to as the DSO) - data of the DSO are included in Appendix No. 1 to the SWZ. The standby seller is: Enea S.A.5. The requirements (obligations) placed on the contractor, are described in the draft provisions of the sales contract, which is Annex No. 2 to the SWZ. 6. the current power sales agreement with the existing seller PGE Obrót S.A. of electricity for the power consumption points included in Attachment No. 1 to the SWZ is concluded for a definite period until 31.12.2022 and does not require termination. As of 01.01.2023, the supply of electricity will be provided by the standby seller Enea S.A7. Appendix No. 1 to the SWZ informatively indicates the current parameters (tariff group/contract power) that may be subject to change during the term of the electricity contract.8. In the course of contract execution, the ordering party reserves the right to reduce the total amount of electricity purchased up to 30%, relative to the consumption of electricity indicated in item 1. The occurrence of the circumstances referred to above will reduce the remuneration due to the contractor for the execution of the contract. (9) The Ordering Party shall have the right, during the term of the contract, to change the tariff groups, contractual power for individual EPPs specified in Appendix 1 to the contract (Annex 1 to the SWZ) after agreeing the technical conditions for making such changes with the Distribution System Operator, hereinafter referred to as the DSO. Changes in the contract will take place upon written notification of the ordering party to the contractor starting from the making of the change by the DSO. The aforementioned changes will be carried out in accordance with the rules set forth in the tariff of the Distribution System Operator appropriate for the Ordering Party and will concern, in particular, ensuring the proper functioning of the facility in question (in accordance with its intended use) and/or reduction of costs on the distribution service.10. The Ordering Party will provide the contractor selected in this procedure with the necessary data and documents to carry out the procedure for changing the seller, immediately after signing the contract.
