Description

The subject matter of the contract is the supply of 110 identically model passenger vehicles adapted to conduct state exams in the category B driving license, with identical technical parameters, color and having identical equipment, for the Provincial Road Traffic Center in Katowice, Częstochowa and Bielsko-Biała. All vehicles must meet the technical conditions in force in Poland and legal requirements appropriate to their intended use. A detailed description of the subject matter of the contract is contained in attachment no. 1 to the SWZ (Terms of Reference)
The subject matter of the contract is the delivery of 110 identically model passenger vehicles adapted to conduct state exams in the category B driving license, with identical technical parameters, color and having identical equipment, for the Provincial Road Traffic Center in Katowice, Częstochowa and Bielsko-Biała. All vehicles must meet the technical conditions in force in Poland and legal requirements appropriate to their intended use. A detailed description of the subject matter of the contract is contained in attachment no. 1 to the SWZ (Terms of Reference). Therefore the Contracting Authority does not allow submitting of partial offers as specified in art. 7 item 15 of the PPL Act. The Contracting Authority does not divide the contract into parts due to its nature. The delivery shall include new cars manufactured in 2022 meeting all minimum requirements described in appendix 1 to the SWZ.Accessibility for disabled persons. With regard to the condition set out in Article 100 of the PPL Act concerning accessibility for persons with disabilities, as referred to in Directive 2014/24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement (OJEU No. 94, p. 65), in accordance with the Ordinance of the Minister of Infrastructure of 28 June 2019 on the examination of persons applying for authorization to drive vehicles, training, examination and obtaining authorizations by examiners and models of documents used in these matters (OJEU of 2019, item 1206), the provision of a vehicle by the examinee in the cases referred to in Article 54, paragraph 5, point 1 or 2 of the Act, respectively, and in the case of an examination conducted for a driving license category B1) - (par. 13, paragraph 1, point 2 of the Regulation) based on Article 54, paragraph 5, point 1 of the Act (Journal of Laws of 2021, item 1212 of 5 January 2011 on driving vehicles). Provisions of paragraphs 1-3 do not apply if the examination is conducted with a vehicle of a disabled person requiring adaptation of the vehicle to the type of disorder.Equivalent offers. Whenever in the terms of reference and in annexes the subject matter of the contract was defined by indicating trademarks, patents or origin, source or specific process that characterizes the products or services provided by a particular contractor, the contracting authority's intention was to present an example of a "type" i.e. definition of minimum quality parameters and performance features of a product, material or technology; in such a case the contracting authority allows submission of equivalent bids and it should be assumed that such indication is accompanied by the expression "or equivalent". The offered equivalent solutions (devices, equipment or materials) shall have parameters no worse than those specified by the Contracting Authority. By the term "minimum quality parameters and performance features" the Contracting Authority shall understand the requirements for materials or equipment contained in generally available sources, catalogs, websites of various manufacturers. Any possible use of exemplary names, marks, etc. is only an example aimed at clarifying the expectations of the Contracting Authority, while maintaining the principle of neutrality of the description of the subject of the contract. If the Contracting Authority refers to standards, European technical assessments, approvals, technical specifications and technical reference systems (certificates) relating to the subject matter of the contract, solutions equivalent to those described by the Contracting Authority shall be acceptable.The Contracting Authority, with respect to the standards referred to in the documentation, specifies that the required standard is the "at least" requirement and allows for the possibility to accept items of the contract that have higher standards equivalent to those described.A contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to prove that the supplies, services or works offered by the contractor meet the requirements specified by the Contracting Authority
