Description

The subject matter of the contract is the comprehensive supply of high-methane natural gas (group E), i.e. the supply of natural gas together with distribution services to the Ordering Party's facilities, in the period from 01.01.2023 to 31.12.2024, divided into two parts of the contract:
(1) The subject matter of the contract is the comprehensive supply of high-methane natural gas (group E), i.e. the supply of gas fuel together with distribution services to the Ordering Party's facilities, in the period from 01.01.2023 to 31.12.2024, divided into two parts of the contract:1.1. Part I of the contract concerns gas consumption points (also called PPG), which will be settled according to the tariff price approved by the President of the ERO, within the meaning of the Act of January 26, 2022 on special solutions to protect gas fuel consumers in connection with the situation on the gas market and competitive market prices (mixed settlement), with a maximum volume of demand for fuel of 37,830,969 - according to Appendix No. 1A to the SWZ description of the subject matter of the contract. Duration of the contract from 01.01.2023 to 31.12.2023.In the event that the Ordering Party is an entity entitled to settle according to tariff prices approved by the President of the ERO, within the meaning of the Act of January 26, 2022 on special solutions to protect gas fuel consumers in connection with the situation on the gas market, it shall sign a GAS FUEL CONSUMER DECLARATION on the destination of gaseous fuel, according to the form attached to the Regulation of the Minister of Climate and Environment of January 28, 2022. The PPG in question may be partially or fully billed according to prices from the Sales Tariff (tariff price) approved by the President of the ERO - the information is included in Appendix No. 1A to the SWZ - description of the subject of the contract. The Statement(s) in question is/are an attachment to these proceedings. The Ordering Party reserves the possibility of changing the scope of the Statement during the term of the contract, i.e. losing the right to settle according to tariff prices and acquiring the right to settle according to tariff prices. In such a case, the Ordering Party will submit an applicable statement in accordance with the actual state of affairs, 3. Gas fuel shall be delivered 24 hours a day to the delivery and consumption points listed in Appendix 1A to the SWZ, which is a set of gas facilities used to connect the internal network owned by the Ordering Party with the gas network of the system operator.4. The Contractor shall be obliged to ensure quality standards of service to the Ordering Party in accordance with the energy law in force in this regard. He shall ensure continuity of supply without any interruptions except as described in the Energy Law, IRIESD, tariff and have a reserve to guarantee continuity of supply. (5) Ownership of the gaseous fuel shall pass to the Customer upon measurement at the gas meter outlet. (6) The demand for gas fuel has been adopted on the basis of historical consumption of gas fuel and may deviate from the actual use of gas fuel, as it is not possible to determine in advance the amount of gas fuel that will be delivered to the Ordering Party. The amount of the order does not constitute an obligation on the part of the Ordering Party to purchase gas fuel in the specified quantity and in no way can be the basis for any claims on the part of the Contractor. During the execution of the order, the Ordering Party shall have the right to:6.1. reduce the quantity of gas fuel, with the minimum amount being 85% of the order quantity indicated in paragraph 1.1 above. The change shall not affect the bid price. The change takes place automatically and does not require a declaration of intent by the Ordering Party,6.2. change of tariff group, in accordance with the rules set forth in the tariffs approved by the President of the Energy Regulatory Office. The change shall not affect the bid price. The change takes place automatically and does not require a declaration of intent by the Ordering Party,6.3. change of tariff group, in order to optimize distribution parameters or to ensure proper operation of the facility (in accordance with its purpose). The change does not affect the bid price. The change requires a declaration of intent by the Purchaser.Full information is contained in Chapter 4 of the SWZ.
