Description

An advanced contract award notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date and time stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
1. Definition of requirement: The Correctional Service Canada has a requirement for an integrated facility, in addition to the current training academy that is located in Kingston, Ontario, to deliver the Correctional Training Program (CTP) in order to hire CSC Correctional Officers / Primary Workers, due to an increased immediate need for Correctional Officers. In order to deliver this 14 week face to face training an integrated facility that includes an infrastructure that will meet all training requirements is required.
1.1 Objectives: Correctional Service Canada (CSC) has a requirement for an integrated facility to deliver training to employees that requires an integrated facility that includes an infrastructure that will meet all training requirements.
1.2 Scope of Work: The Contractor must provide a training facility to support ongoing needs for the CSC Correctional Officer in-person training course, including accommodations, classrooms and firearms storage. The services the Contractor must provide include but are not limited to:
1. Coordinating bi-monthly meetings with the CSC Project Authority or delegate to ensure the deliverables are met and issues are managed in a timely manner.
2. Establishing committees for food services and accommodations where the Contractor and CSC will be represented.
3. The Contractor must cover all utility costs associated with the delivery of all services provided. This includes but is not limited to, electricity, water, gas, and lighting.
4. In case of emergencies must be responsive to changing needs or concerns in relation to deliverables within a reasonable timeframe. (e.g., damage due to extreme weather, viral outbreaks and pandemic.)
5. Provide any other services requested by CSC for the successful delivery of the CTP training.
1.3 Tasks
1.3.1 The Contractor must:
1. Provide referenced infrastructure for full use no later than September 1st, 2020.
2. Provide integrated infrastructure as noted in detail within this Statement of Work that can accommodate up to 128 recruits and 25 staff at any given time.
3. Inform CSC of any planned changes that may affect the CTP curriculum and delivery schedule six weeks in advance. For any unplanned incidents that will affect the CTP curriculum and delivery schedule, the Contractor must inform CSC at the earliest time possible. In both cases, the Contractor must provide a workaround planned with the best available options for CSC’s approval.
4. With CSC concurrence, assist CSC to identify potential efficiencies that will benefit both the Contractor and CSC (e.g., training, space allocation and integration of resources).
5. Provide required space for the storage of equipment related to CTP delivery as listed in Schedule IV, four months prior to CTP delivery start date, in accordance with the CTP calendar.
6. Provide access to the training facilities to CSC staff from date of contract award, in order to prepare the delivery of the training program.
7. Provide access to CSC staff to the training infrastructure (including, but not limited to, firearms range, mat room, gym) two months prior to the start of the first CTP.
8. In cases of emergencies or unforeseen circumstances, if the infrastructure becomes inaccessible, the Contractor must provide viable alternative options for space and services that meet CSC’s requirements at any given time as listed in this statement of work.
9. Provide exterior bilingual signage throughout the training facility for directions to the CSC dedicated training building. The Contractor must obtain approval from the CSC Academy Manager for all signs.
10. Provide access to, and use of, the following services and training facilities for each scheduled CTP:
a) Internet access (WIFI or LAN drops) must be provided by the Contractor for CSC recruits and staff in the CSC training facility.
b) Parking for CSC recruits and staff, as well as up to seven vehicles linked to the delivery of CTP.
c) Accommodations
i. Each CTP cohort of up to 32 recruits must be accommodated in semi-private (2 bedrooms, 1 washroom with shower), private (1 bedroom, 1 washroom with shower) hotel type accommodation and/or dorm houses (4 bedrooms, 1 washroom with shower) within a 5 minute walking distance of each other. The accommodation space must be for CSC recruits only, unless otherwise agreed upon between the Contractor and CSC.
ii. Once CTP recruits are assigned to a room, the recruits will continue to use that room for the duration of the training unless relocation is required due to operational necessity like maintenance on rooms or operational needs due to pandemic situation. If the operation requirements are due to planned operational activities (maintenance and repair on rooms), the contractor and must give a three weeks notice to CSC.
iii. Accommodations must include all bed linen, face cloths and towels.
iv. Accommodations need to be within a 10 minute walking distance to the various training facilities (gym, simulation space, classrooms), the location where meals will be served and have laundry, parking, internet, a room for boot cleaning and private or semi-private washrooms including showers and within a 20 minute walk to the firearms range.
v. The Contractor must provide cleaning services, supplies and equipment including vacuum cleaners, garbage removal as and when required. The Contractor must provide cleaning Services at a minimum of once per week, including, but not limited, to linen change, cleaning of all washrooms, cleaning of common areas. In cases of viral outbreaks, the Contractor will need to provide increased cleaning services on an as requested basis, based on recommendations from Health Canada and/or Provincial Health Authorities as agreed upon between the Contractor and CSC.
vi. In cases of emergencies the Contractor must be able to house the recruits in an area that is reasonably equivalent, were the Contractor must provide meals to the recruits.
vii. In cases of viral outbreaks, the Contractor must provide separate accommodations with private washroom for recruits to move to temporarily for isolation from the remainder of the CTP cohorts. Chosen isolation space should not be close to the living space of the remaining cohort and must be accessible to provide medical intervention and food.
d) Daily meals, including hot breakfast, lunch, dinner and take away evening snack. (See example on schedule V.)
i. For each CTP recruit, while attending scheduled training.
ii. Meal periods to be arranged to maximize CSC and the Contractor training schedule efficiencies.
iii. Provide box lunches for each CTP recruit for firearms range delivery days.
iv. Must have capability to provide meals during times of emergency.
v. In cases of viral outbreaks, the Contractor must provide meals in take-away disposable containers and deliver them to recruits that are in isolation from the remainder of the CTP cohorts.
e) Catered Formal Pre-Graduation Dinner
i. Provide a formal 3 course dinner for each CTP cohort, as well as the trainers. This will be approximately one week prior to the graduation date. The date of the dinner must be arranged between Contractor and CSC with the CTP planning Schedule. No servers for the meal are required as CSC will be responsible for the service. Dinner must be between the hours of 18:00hrs and 20:30hrs.
ii. Provide linens.
iii. Provide bartender service for alcohol purchase by CSC staff and recruits (if CSC decides to allow for this service).
f) CSC Training Center.
The Contractor must provide:
i. Three (3) dedicated classrooms each large enough to accommodate 32 participants and 4 trainers. Each classroom must have internet and secure wall structure to hold a 90” TV and large white boards.
ii. Four (4) dedicated storage spaces within the primary training center. These spaces must have shelving and be approximately 20’ x 20’ in size. This space must be secure and dedicated only to CSC and will be used to store equipment, including but not limited to, fire safety equipment, security equipment, and uniforms.
iii. Dedicated gym space to accommodate groups of 36 individuals at a time, with training mats. The training mats must meet the professional standards style of Martial Arts mats. The ceiling height needs to be above 10ft. and accommodate personal space of 4’ x 4’ for each of the 36 individuals.
iv. Dedicated office space for CSC coordinators and trainers.
a. Trainer Office Space and storage space must be available to accommodate 22 trainer desks, a boardroom space large enough to accommodate 26 staff, and a binder storage area (Appx. 20’ X 20’).
b. Administrative space is required for two administrators and two managers, that must include storage, internet access and the ability to secure the offices.
v. Two dedicated simulation spaces are required to mirror an institutional setting for medium security and maximum security ranges with cells. The simulation spaces need to be separate from each other and be able to accommodate training space for 32 participants in each as per Schedule I. Audio and visual capabilities are required for each space that cannot be seen from the viewing gallery. (e.g., inside each cell). The simulation space must be no smaller than the Training facility floor plan as per Schedule I.
vi. Dedicated cleaning services for the CSC Training Center five days a week. The Contractor must ensure the cleaning practices used reduce the risk of spreading infectious diseases. In cases of viral outbreaks, the Contractor must provide increased cleaning services based on Health Canada and/or Provincial Health recommendations, in agreement between the Contractor and CSC.
g) Firearms vault
i. Dedicated space for CSC firearms based on the number of firearms as identified in Schedule IV and must be within a 10-minute drive or less to the primary training center.
ii. The space must have humidity control.
iii. The space must meet the provincial and national regulations for firearms storage.
iv.Dedicated space for 32 recruits and 4 trainers for the cleaning of firearms in the vicinity of the firearms vault that includes tables.
h) Ammunition vault
i. A separate dedicated space for CSC ammunition based on the amount of ammunition as identified in Schedule IV that must be within 10-minute drive or less to the primary training center.
ii. The space must meet the provincial and national regulations for ammunitions storage.
i) Firearms 16 Lane, 100m Training Range
i. Must be the primary range for CSC firearms training and to be within 20 minute walk or less to the primary training center.
ii. Each lane must be at minimum 1.5m wide.
iii. CSC will book the training Range through the Contractor’s scheduling staff.
iv. Range can be indoor or outdoor but must be a minimum of 50 meters and allow CSC firearms caliber (5.56mm carbine, 12 gauge shotgun, 9mm pistol) and must allow for a ground shot with the 12 gauge (#4 buck shot).
v. The Contractor must provide grass cutting, snow and ice removal prior to 08:00 on range days identified in the schedule and include areas on the range from platforms to targets, including platforms, walking paths, parking areas and classroom entrance areas.
vi. If an outdoor range is provided, it must have a shooting platform that is covered and off the ground, be a minimum of 4 feet and 11 inch wide by 4 feet and 4 inch off the ground and be able to accommodate shooting positions including standing barricade, prone and kneeling.
vii. The Contractor must decontaminate the range as per federal government regulations.
viii. The Contractor must manage the recycling of used brass casings.
ix. The Contractor must provide a storage area specific for equipment CTP Firearms training, located at firearm range. The storage area must be large enough to store training equipment including but not limited to shooting targets, wooden target boards, hearing protection, staple guns, staples, and not including Firearms or Ammunition.
j) Firearms Range Classroom
i. The Contractor must provide a firearms range classroom that meets CSC firearms training requirements and includes sufficient space for 35 persons, parking in the vicinity and washrooms.
k) A dedicated space for Indoor Firearms range
i. The Contractor must provide an indoor firearms range that meets CSC’s approximately one day 40mm Launcher training per CTP.
ii. The Contractor must provide access to this range to CSC on an as requested basis.
iii. CSC will book the indoor firearms range through the Contractor’s scheduling staff.
l) A dedicated space for Fire Safety Training
i. Must include a Fire-pan and hydrant at Fire Training Compound.
ii. The Contractor must provide an area for fire safety training that meets the requirements of CSC’s Fire Safety Training, within the hours of operation of the Contractor.
iii. CSC will book the fire safety training area through the Contractor’s scheduling staff.
m) Fitness Gym
i. The contractor must provide a fitness gym that meets the requirements of CSC’s Fitness Program, within the hours of 0600 hours to 2100 hours, seven days a week and includes both cardio and weight equipment.
ii. The fitness gym must meet the requirements of CSC’s Baton and Chemical Agent Program.
iii. CSC will book the fitness gym through the Contractor’s scheduling staff.ii. iii. n) Parade and graduation space
n) Parade and graduation space
i. Must provide an indoor dedicated space for Parade and Graduation ceremony. Space must be indoors, must accommodate up to 130 people for Graduation, and must allow space for cohorts of 32 (4 persons wide by 8 rows).
o) Marching and Parade (outdoors)
i. Provide an outdoor space for cohorts of 32 (4 persons wide by 8 rows) to March to and from various training spaces, accommodations, meal areas, graduation parade or other areas outside the primary training facility.
1.4 Expected results: As part of Correctional Officer selection process to provide a training facility and access to services to support ongoing needs of the CSC’s Correctional Officer recruits, 14 week in person training course, Including accommodations, classrooms and firearms storage.
1.5 Performance standards: The Contractor must provide an integrated facility that includes an infrastructure that will meet all training requirements as described in Tasks and Deliverables, including but not limited to accommodations, classrooms and firearms storage. Thefacility must meet the requirements of CSC’s National Training Standards found in the CTP Planning document, Firearms Safety Protocol, as well as Commissioner’s Directive 567-5 Use of Firearms (2018-12-10).
1.6 Deliverables: 1.6.1 The Contractor must provide the following: 1. Referenced infrastructure for full use. 2. Integrated infrastructure as noted in detail within this agreement that can accommodate up to 128 recruits and 25 staff at any given time. 3. Inform CSC of any planned changes that may affect the CTP curriculum and delivery schedule six weeks in advance. 4. Identify potential efficiencies that will benefit both organizations (i.e. training, space allocation and integration of resources). 5. Required space for the storage of equipment. 6. Access to the training facilities to CSC staff from date of contract award. 7. Access to CSC staff to the training infrastructure. 8. If the infrastructure is not fully accessible, viable alternative options for space and services at any given time. 9. Exterior bilingual signage throughout the training facility. 10. Internet access (WIFI or LAN drops) for CSC recruits and staff in the CSC training facility. 11. Parking for CSC recruits and staff, as well as up to seven vehicles linked to the delivery of CTP. 12. 1.6.2 Paper consumption: a. Should printed material be required, double-sided printing in black and white format is the default unless otherwise specified by the Project Authority. b. The Contractor must ensure printed material is on paper with a minimum recycled content of 30% and/or certified as originating from a sustainably managed forest. c. The Contractor must recycle unneeded printed documents (in accordance with Security Requirements).
1.7.1 Constraints The Contractor must immediately report to the Project Authority, by telephone with a follow up by electronic mail, any urgent issue that arises during the course of the work that could impact on itsprogress, implementation or operation.
1.7.2 Location of work: a. The Contractor must perform the work at the contractor's place of business. Summerside, PEI
b. Travel
No travel is anticipated for performance of the work under this contract.
1.7.3 Language of Work: The contractor must perform all work in English.
1.7.4 Security Requirements:
This contract includes the following security requirements: 1. The Contractor/Offeror must,at all times during the performance of the Contract/Standing Offer, hold a valid Designated Organization Screening (DOS), issued by the Contract Security Program (CSP), Public Works and Government Services Canada (PWGSC). 2. The Contractor/Offeror personnel requiring access to sensitive site(s) must EACH hold a valid RELIABILITY STATUS, granted or approved by the CSP, PWGSC. Until the security screening of the Contractor personnel required by this Contract has been completed satisfactorily by the CSP, PWGSC, the Contractor personnel MAY NOT ENTER sites without an escort. 3. Subcontracts which contain security requirements are NOT to be awarded without the prior written permission of the CSP, PWGSC. 4. The Contractor/Offeror must comply with the provisions of the: a)Security Requirements Check List and security guide (if applicable), attached at Annex ‘’C’’ in the resulting contract; b) Industrial Security Manual (Latest Edition).
2. Criteria for assessing the statement of capabilities (minimum essential requirements): Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
Accommodations: must provide accommodations for for 96 recruits at any given time in a fiscal year, and must be able to accommodate cohorts of 32 in close vicinity to each other. Accommodations must have access to laundry, parking, internet, a room for boot cleaning and private or semi-private washrooms. Rooms must mirror a three start hotel standards.
Meals: must meet the specific dietary standards as per the Canada food guide and must accomodate religious and medical diets. Meals must be served three times daily, seven days a week to 96 participants within 90-minute timeframe for each meal. At some point in the training schedule, the Contractor must provide box lunches and must deliver hot food to the firearms range as requested by CSC.
  Firearms Range : must be 100 or 50 meters in length, have 16 live shooing lanes, a range classroom that can accommodate 32 participants, storage on site (approximately the size of a 40ft shipping container, also know as a C-Can), parking, washroom facilities, be within no more than a 10 minute drive from the primary training centre. The classroom at the range must be located at a safe distance in the perimeter. The firearms range and classroom must be accessible and maintained 12 months of the year.
Firearms vault and ammunition vault: Must comply with safety standards and be large enough to store approximately 800,000 rounds of ammunition and approximately 180 firearms.
Three Classrooms : Each classroom must be large enough to accommodate 32 participants and four trainers, have internet and have secure wall structure to hold 90’ TV and large white boards. Must be in the primary training building.
Two simulation spaces: must mirror an institutional setting for medium security and maximum security. The simulation spaces must be separate from each other and be able to accommodate training space for 32 participants in each. Each stimulation space must include audio and visual capabilities. Must be in the primary training building.
Four (4) storage spaces : must be located within the primary training building. These spaces must have shelving and be approximately 20’ X 20’ in size. These spaces must be secure and dedicated only to CSC.
Correctional Trainer Office space and storage space : Must be able to accommodate 22 desks for trainers , a boardroom space, and a binder storage area. Must be in the primary training building.
Administrative Space: Must include office space for two (2) administrative staff and one manager, storage, internet and ability to secure offices. Must be located in the same building as the classroom space.
Weight and Cardo fitness area : must be available for extended hours and within walking distance to the primary training facility and accommodations. The fitness area must be large enough to accommodate 32 people and have shower facilities and washrooms.
Dedicated gym space : Must be large enough to accommodate a group of 36 individuals at a time, with grapplingmats with a minimum 1.5-inch thickness. The ceiling height needs to be at least 10ft and accommodate matted floor personal space of at least 4’ X 4’ for each of the 36 individuals.
Fire Safety training Facility : Must have a fire pan, hydrant and fire safety-training compound.
3. Applicability of the trade agreement (s) to the procurement
This procurement is subject to the following trade agreement (s):
Canada – Chile Free Trade Agreement (CCFTA); Canadian Free Trade Agreement (CFTA); World Trade Organisation-Agreement on Government Procurement (WTO-AGP). The procedural requirements of the other international trade agreements will be fulfilled following compliance to the procedural requirements of CCFTA , CFTA, WTO-AGP and/or the CETA.
4. Set-aside under the Procurement Strategy for Aboriginal Business This procurement is not subject to any set-asides for Aboriginal Suppliers.
5. Comprehensive Land Claims Agreement (s) This procurement is not subject to a Comprehensive Land Claims Agreement.
6. Justification for the Pre-Identified Supplier The pre-identified supplier is able to provide an integrated facility and the required services that meet all of the minimum essential requirements described in this ACAN. Holland College is a registered Canadian College that meets all of CSC's requirements for the delivery of the 14 week face-to-face, in person Correctional Training program CTP, including, but not limited to: accommodations, meals, firearm rage, firearms vault and ammunition vault, three classroom space, two simulation space, four storage space, a correctional officer trainer office space, administration space, weight and cardio fitness area, a dedicated gym space and fire safety training space. Correctional Service of Canada has a requirement to deliver the Correctional Training program (CTP) in order to hire CSC Correctional Officers/Primary Workers.
7. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection:
(d) only one person is capable of performing the contract.
8. Exclusions and/or Limited Tendering Reasons The following exclusion (s) and/or limited tendering reasons are invoked under the section of the trade agreement (s) specified:
Canada Chile free trade agreement (CCFTA, Article Kbis-09 b. where, for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
Canadian Free Trade Agreement (CFTA), Article 513 (b) if the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist for any of the following reasons: (i) the requirement is for a work of art; (ii) the protection of patents, copyrights, or other exclusive rights; (iii) due to an absence of competition for technical reasons; (iv) the supply of goods or services is controlled by a supplier that is a statutory monopoly; (v) to ensure compatibility with existing goods, or to maintain specialized goods that must be maintained by the manufacturer of those goods or its representative; (vi) work is to be performed on property by a contractor according to provisions of a warranty or guarantee held in respect of the property or the original work; (vii) work is to be performed on a leased building or related property, or portions thereof, that may be performed only by the lessor; or (viii) the procurement is for subscriptions to newspapers, magazines, or other periodicals;
World Trade Organisation-Agreement on Government Procurement (WTO-AGP) - Article XV: (b) when, for works of art or for reasons connected with protection of exclusive rights, such as patents or copyrights, or in the absence of competition for technical reasons, the products or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists;
9. Ownership of Intellectual Property There are no intellectual property terms in the contract.
10. Period of the proposed contract or the delivery date(s) The proposed contract is for a period of 7 months, from September 01/2020 to March 31/2021, with an option to extend the contract for four (4) additional one-year periods.
11. Cost estimate of the proposed contract The estimated value of the contract, including option(s), is $13,369,342.39 (GST/HST extra).

Suppliers' right to submit a statement of capabilities Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN, may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date and time of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
14. Closing date and time for a submission of a statement of capabilities The closing date and time for accepting statements of capabilities is August 14th, 2020 at 2:00 PM EST.
