THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FEDERAL ACQUISITION REGULATION (FAR) SUBPART 12.6-STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS-AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED. 

This solicitation is a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2019-04 effective August 7, 2019.

The associated North American Industrial Classification System (NAICS) code for this procurement is 334516 with a small business size standard of 1,000 employees.
The National Institute for Standards and Technology (NIST) supports accurate and compatible measurements by certifying and providing standard reference materials with well-characterized composition or properties, or both. NIST is developing a new standard reference material for calibrating the scattering vector of small angle X-ray scattering (SAXS). SAXS measurements are currently calibrated by a variety of methods that do not have sufficient repeatability and accuracy for many applications of SAXS. The reference material required is a two-dimensional nanopatterned grating of gold, platinum, or tungsten on an ultrathin silicon nitride membrane. The grating will scatter X-rays with well-defined peaks. The high electron density of gold, platinum, or tungsten will make the structures scatter very strongly and allow them to work on laboratory systems in addition to synchrotrons. NIST requires a set of nanostructures fabricated to allow testing of the accuracy and reproducibility of the measurement.
The Government intends to award up to three purchase orders.
Responsible quoters shall provide a quotation for all of the following line items.
LINE ITEM 0001: QTY MINIMUM of 8 SEPARATE NANOPATTERNED GRATINGS, meeting all of the required specifications:
Specifications:
1. Substrate frame shall be silicon wafer of 10 mm x 10 mm and a minimum of 200 micrometers thick and maximum of 400 micrometers
2. Grating shall be centered on a silicon nitride membrane that is 1 mm x 1 mm and nominally 100 nm thick
3. Grating pattern shall be 400 micrometers x 400 micrometers in size following two dimensional pattern in attached document
4. Grating shall be made of gold, platinum, or tungsten
5. Grating lines shall be between 100 nm and 110 nm tall
6. Grating lines shall have 100 nm pitch (+- 1 nm).
7. Grating line width shall be between 35 nm and 45 nm or 55 nm and 65 nm
8. Line edge roughness shall be ≤ 4 nm
9. Sidewall angles shall be greater than 85 degrees
10. Any adhesion layers shall be less than 5 nm thick
11. Metal film thickness shall vary less than +-5% across wafer

DELIVERY
Delivery of LINE ITEM 0001 shall be completed not later than 90 days from the date of award.
Delivery terms shall be FOB Destination. The Contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery.

Normal business hours at the NIST are Monday through Friday, 8:30 a.m. to 5:00 p.m. Eastern Time except for Federal holidays or other official closures.
TESTING and ACCEPTANCE CRITERIA
After delivery of the item, NIST will inspect and perform acceptance testing to determine that all minimum required specifications have been met. Acceptance testing shall occur not later than 14 business days from the date of the delivery.

Final acceptance by the Government will be given after successful delivery, and demonstration of item specifications.
PAYMENT SCHEDULE
The contractor shall be paid in one lump sum payment upon submission of a proper invoice, and upon submission by the Contractor and acceptance by the Government, of the required Nanopatterned Gratings. Partial payments shall not be authorized.
EVALUATION CRITERIA AND BASIS FOR AWARD
Award shall be made to the offerors whose proposal offers the best value to the Government. The Government will evaluate information based on the following evaluation criteria:

Price
Technical Capability:
Evaluation of Technical Capability will be based on the requirements of the specifications and information provided in the proposal. Offerors shall include a detailed diagram of the product they intend to deliver along with documentation that clearly explains how it will meet the specifications. Also discuss your capability to provide a larger quantity (up to 50+ each) in a future contract.
Under the Technical Capability factor, stronger consideration will be given for:
1. Better repeatability of the pitch (spec #6). Better repeatability means a smaller variation in the 100 +-1 nm pitch. There is no preference as to whether the average value is for example 100 nm or 100.5 nm (as long as it is between 99 nm and 101 nm), so 100.5 +-0.1 nm is better than 100 +-0.5 nm. The benefit is improved repeatability of the pitch.
2. Reduced line edge roughness (spec #8). The amount as to which it is less than 4 nm is considered better.
Price
Price will be evaluated to determine that the total evaluated price is consistent with the technical portion of the quotation and is a fair and reasonable overall price to the Government.
REQUIRED SUBMISSIONS
All quoters shall submit the following within their quotation:
1) A firm-fixed price, FOB Destination price quotation, which addresses all line items.
2) One electronic copy of technical description and/or product literature. Quoters shall include the manufacturer, make and model of the product, manufacturer sales literature or other product literature which CLEARLY DOCUMENTS that the offered product meets or exceeds the required specifications stated herein. It is the responsibility of the quoter to ensure that all specifications are clearly documented;
3) If product literature does not address any given specification, a discussion of how the Contractor will meet or exceed that required specifications. Modifications to the quoted system must be discussed;
4) The timeline for delivery;
5) This is an Open-Market Combined Synopsis/Solicitation for equipment, as defined herein. The Government intends to award a Purchase Order resulting from this Combined Synopsis/Solicitation that will include the terms and conditions that are set forth herein. In order to facilitate the award process, ALL quotes shall include a statement regarding the terms and conditions herein as follows:
a. The quoter shall state "The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition."

b. The quoter shall state "The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:"
Quoter's shall list exception(s) and rationale for the exception(s)
Please note that this procurement IS NOT being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If a quoter submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the offeror's FSS or GWAC contract, and the statement required above shall be included in the quotation;
6) The Dun and Bradstreet Number (DUNS number) for the quoter's active System for Award Management (SAM) registration. Quoters must have an active registration at www.SAM.Gov to submit a quote;
7) Quoters shall include a completed copy of the provision, "Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) (March 2015)" with their quotation. Incorporated, herein, in full text.
DUE DATE FOR QUOTATIONS
All quotations must be submitted via e-mail to Erin Dwyer, Contract Specialist, at erin.dwyer@nist.gov. FAX quotations will not be accepted.
Submission must be received not later than 3:00 p.m. Eastern Time on August 23, 2019. A quotation shall be considered received when it is received in the electronic inbox of Erin Dwyer not later than the date and time identified herein.

NIST LOCAL-53 CONTRACT PERFORMANCE DURING CHANGES IN NIST OPERATING STATUS
Unless otherwise stated in the contract terms and conditions, normal days of business operation are Monday through Friday, excluding Federal Holidays. However, throughout the contract period of performance, there may be circumstances beyond the control of the U.S. Department of Commerce, National Institute of Standards and Technology (NIST), that will impact normal days of business operation, such as inclement weather, power outages, etc. In circumstances such as these, the Contractor must call the appropriate NIST campus status line to verify the operating status:

During a lapse in appropriation, access to Government facilities and resources, including equipment and systems, will be limited to excepted personnel for both Federal employees and Contractor personnel. If performance of the contract is onsite and/or requires Government interaction, unless you have been, or are notified that you are to work under an excepted status, you will automatically enter a temporary work stoppage. The work stoppage shall remain in effect until the lapse is resolved and notification is provided via the NIST website at https://www.nist.gov/ and/or the NIST operating status lines. Additionally, contractors are encouraged to monitor public broadcasts or the Office of Personnel Management's website at www.opm.gov for the Federal Government operating status.
NIST will provide notification to all contractors that are determined to have excepted status. All excepted contractors are required to continue performance and communicate with the appointed Contracting Officer's Representative (COR) for further guidance, or NIST Contracting Officer if a COR is not appointed.
Contractors with supply or service contracts that are fully funded at the time of contract award and do not require access to Government facilities, resources, or active administration by Government personnel in a manner that would cause the government to incur additional obligations during the lapse in appropriation may continue performance.

NIST LOCAL-54 ELECTRONIC BILLING INSTRUCTIONS
NIST requires that Invoice/Voucher submissions are sent electronically via email to INVOICE@NIST.GOV. Each Invoice or Voucher submitted shall include the following:
(1) Contract number;
(2) Contractor name and address;
(3) Unique entity identifier (see www.sam.gov for the designated entity for establishing unique entity identifiers);
(4) Date of invoice;
(5) Invoice number;
(6) Amount of invoice and cumulative amount invoiced to-date;
(7) Contract Line Item Number (CLIN);
(8) Description, quantity, unit of measure, unit price, and extended price of supplies/services delivered;
(9) Prompt payment discount terms, if offered; and
(10) Any other information or documentation required by the contract.
