Description

1) The subject matter of the contract is the "purchase and delivery of 31 four-wheel drive off-road vehicles SUV with additional specialist equipment", delivery of the subject matter of the contract to the Ordering Party's registered office, and performance of product training. 2) The vehicles have to ensure that inspectors from the Department of Environmental Protection of the Chief Inspectorate for Environmental Protection can travel across the country, get to voivodeship environmental protection inspectorates and their delegations, prosecutor's offices, the police, and to places where official activities are undertaken and carried out, as well as transport specialist equipment. In addition, the vehicles must be able to travel over terrain (forest, field, agricultural, wetland, sandy, with a high degree of unevenness and slope angles) impossible to traverse for single-axle vehicles. The vehicles will be used for tasks related to recognition, prevention and prosecution of environmental crimes and offences.
This order is divided into parts, each of which is subject to separate proceedings. 2. This procedure concerns 2 parts of the contract3. The Contracting Authority does not allow submitting partial offers as described in art. 7 item 15 of the PPL Act.4 The subject matter of the contract is the "Purchase and delivery of four-wheel drive SUVs with additional specialist equipment" in the number of 31, delivery of the subject matter of the contract to the seat of the Contracting Authority and performance of product training.5 The vehicles are to provide inspectors with the possibility to obtain the necessary equipment to carry out inspections of the vehicles.The vehicles have to ensure that inspectors from the Department of Environmental Protection of the Chief Inspectorate for Environmental Protection can travel throughout the country, get to voivodeship environmental protection inspectorates and their delegations, to prosecutor's offices, to the police, to places where official activities are undertaken and carried out, and to transport specialist equipment. In addition, the vehicles must be able to travel over terrain (forest, field, agricultural, wetland, sandy, with a high degree of unevenness and slope angles) impossible to traverse for single-axle vehicles. The vehicles will be used for tasks related to identification, prevention, prosecution of crimes and offences against the environment defined in the Criminal Code, the Code of Offences and the laws listed in Article 10b (1) of the Act of 20 July 1991 on the Environmental Protection Inspection (Journal of Laws of 2020, item 995, as amended) including the Act of 20 July 2017. Water Law (Journal of Laws 2017, item 1566, as amended).7. The official cars intended for the inspectors of the provincial inspectorates of environmental protection are to ensure the possibility of carrying out the tasks, indicated in the Water Law as the bodies competent to control the observance and application of the aforementioned Nitrate Directive and introduced by the Regulation of the Council of Ministers of 12 February 2020 on the adoption of the "Programme of measures to reduce water pollution with nitrates from agricultural sources and to prevent further pollution." Farmers engaged in agricultural production, including special divisions of agricultural production, and activities where fertilizers are stored or used are controlled (Article 102 of the Water Law Act). There are over 1 million such entities in Poland; provincial environmental protection inspectors conduct over 2,000 such inspections annually. Reaching an agricultural holding, especially a place where natural fertilizers are stored (in the fields) requires a means of transport adjusted to drive on dirt roads in all weather conditions. In addition to inspectors, CLB samplers will participate in inspections (sampling of fertilizers, leachate, soil and water from receivers). The cars will be used by inspectors of the Chief Inspectorate for Environmental Protection to participate in the above mentioned inspections carried out by inspectors of provincial inspectorates for environmental protection or within inspection teams appointed by the Chief Inspectorate for Environmental Protection. This description should be read together with the changes to the wording of the SWZ, which are for instance the result of answers to the questions asked by contractors.
