Description

The subject matter of the Order is the supply of mobile phones, including office and assembly phones and modems for Polska Spółka Gazownictwa Sp. z o.o. under a framework agreement.
I. The subject matter of the Order is:1) the supply of mobile telephones, including office and fitter's telephones and modems (hereinafter referred to as: the Equipment) for the Ordering Party under the Agreement; 2) the provision of workshops for designated employees of the Ordering Party on the use and functionality of the offered Equipment for a maximum of 40 clock hours.II. A detailed description of the subject matter of the contract including quantities of the Equipment is specified in Annex 1 - Description of the subject matter of the contract to the model Contract constituting Annex 3 to the ToR. The Contracting Authority shall conclude a framework agreement with maximally 1 (one) Economic Operator who submits the most advantageous tender (in order of received points) in this Procedure.IV. The Contracting Authority shall procure the Equipment according to its own needs. However, the Ordering Party shall be obliged to order the Equipment in the minimum quantities specified in Appendix 1 - Description of the subject matter of the contract to the model framework agreement constituting Appendix 3 to the SWZ.V. The Ordering Party is not obliged to order the Equipment with the maximum value specified in § 6.1.1 of the Specimen Framework Agreement constituting Annex 3 to the SWZ and in the maximum quantities indicated in Annex 1 - Description of the subject matter of the contract to the Specimen Agreement constituting Annex 3 to the SWZ.VI. The Contractor: once every calendar quarter (i.e. for the quarter: January - March, April - June, July - September, October - December) until the 5th working day of the month following the end of a given quarter, or regardless of the above, at a separate request of the Ordering Party (submitted not more frequently than once a month), within 5 working days from the date of the Ordering Party's request, shall prepare a collective report on the status of the Contract performance, including a listing of the numbers and models of the Equipment, as well as a summary of invoices issued in total and by organizational units of the Ordering Party. The subject matter of the contract must meet the requirements defined in the ToR. In order to confirm that these requirements are met, the Economic Operator has to submit, together with the tender, the said means of evidence indicated in item 5 of the ToR. If the Economic Operator fails to submit such evidence or if the submitted evidence is incomplete, the Contracting Authority will call for its submission or completion within the deadline set not shorter than 10 days.
