Description

A detailed description of the subject matter of the contract, assortment and estimated quantities are given in the Assortment and Price Form (Annex 2 to the ToR) and in the Contract Proposal - Annex 5 to the ToR.3Deliveries will be provided to Szpitalali Pomorskich Sp. z o. o. for the Orderer's location in Gdynia and Wejherowo:a) Central warehouse of the Polish Maritime Hospital, 81-519 Gdynia, ul. Powstania Styczniowego 1W between 7:30 a.m. and 1:30 p.m. (task 1-22).b) Warehouse of the St. John's Hospital, ul. Wincentego a´Paulo, 81-348 Gdynia 1 Wójta Radtkego Street, from 7:30 to 13:30 (task 1-22).b) Magazine - F. Ceynowy Hospital, 84-200 Wejherowo, 10 Jagalskiego Street, from 8:00 to 14:00 (only for sentence 9).4th The offered object of the order must be brand new, unused, free from defects and damage, not subject to third party rights and meet the current technical and quality standards, all parameters and requirements set out in Annex 2 to the ToR (Assortment and Price Form) and must meet the requirements for its marketing and use, set out in the Act of 20 May 2010 on Medical Devices (i.e. Journal of Laws of 2019, Pursuant to art. 29 item 3 of the Public Procurement Law, in case of applying to description of the subject matter of the contract, trademarks, patents or origin, source or specific process which characterizes products or services provided by a particular Economic Operator, the Contracting Authority shall allow submitting tenders for the described assortment or equivalent. By equivalence the Contracting Authority means offering goods with the same technical parameters, functionality and properties, but of a different manufacturer6. Pursuant to art. 30 item 4 of the Public Procurement Law, by describing the subject matter of the contract by reference to standards, European technical evaluations, approvals, technical specifications and technical reference systems referred to in art. 30 item 1 point 2 and item 3 of the PPL Act, the Contracting Authority shall allow solutions equivalent to those described. An economic operator who invokes solutions equivalent to those described by the Contracting Authority is obliged to prove that the supplies, services or works offered by him meet the requirements specified by the Contracting Authority. A contractor who invokes solutions equivalent to those described by the Awarding Entity is obliged to prove that the supplies, services or works offered by him meet the requirements specified by the Awarding Entity.8 Note: Applies to Task 15. The contractor shall lend a wall device for automatic dosing of the working solution free of charge for the duration of the contract, and shall ensure its efficient and uninterrupted use throughout the contract. In addition, the Contractor shall ensure that the proper functioning of the device in question is checked at least once every six months.
