Description

The subject of the contract is the purchase of equipment for the realization of the investment: "Purchase of medical equipment and equipment for the implementation of oncological procedures in the SP ZOZ of the Provincial Specialist Hospital No. 3 in Rybnik" for the Independent Public Healthcare Facility of the Provincial Specialist Hospital No. 3 in Rybnik. The delivery specification is contained in Annex 1 to the Specification of Important Order Terms and Conditions ("Offer Form"), and the detailed characteristics are contained in Annex 1.1 ("Price Form"), 1.2 ("Technical Specification"). Annex 1.3 to the specification ("Quality and Service Guarantee Conditions") - Chemotherapy Seats - Fast-track Procedure - Justification: A previous contract covering the product range in question (Procedure No. TAM-568-PN/77-2019) was cancelled pursuant to Article 93(1)(4) of the aforementioned Act ("The Awarding Entity shall cancel the contract award procedure if the contract has been awarded in accordance with Article 93(1)(4) of the above Act"): the most advantageous tender price (...) exceeds the amount which the contracting authority intends to spend on financing the contract, unless the contracting authority can increase that amount to the most advantageous tender price'). In the procedure in question, two bids were submitted, one of which was subject to rejection, while the price of the other bid exceeded the amount which the contracting authority intended to use to finance the contract, and the contracting authority could not increase that amount to the price of the most advantageous bid. Therefore, due to the urgent need to implement the contract (grant agreement for the assortment covered by this contract with a strict deadline for its settlement), it is necessary to conduct an open tender procedure in the full (EU) procedure, with a shortening of the deadline for submission of offers not less than 15 days (pursuant to Article 43 paragraph 2b(2) of the aforementioned Act). Applying the full deadline for submission of tenders (i.e. 35 days) for the second time would result in the impossibility of settling the above mentioned grants.
