Description

The subject of the contract is: provision of services of collection, transport and disposal of medical waste generated in connection with the activity conducted by the Awarding Entity, hereinafter referred to as waste: with codes: 18 01 02*, 18 01 03*, 18 01 06*, 18 01 08*, 18 01 09 - in accordance with the catalogue of waste specified in the Regulation of the Minister of Climate of 2 January 2020. (Journal of Laws 2020, item 10).Total estimated quantity of waste during 20 months of contract execution: about 267 010 kg. The amount of waste will depend on the number of patients and the number and type of treatments performed. The Orderer expects to provide, for example, waste in the estimated weights specified in the table below.2. Waste collection schedule:2.1. waste with codes 18102* and 180103* will be collected every Monday, Wednesday and Friday, between 8:00 and 14:00. If these days fall on a statutory holiday, waste collection must be made no later than on the working day following it; 2.2. waste with codes: 180106*, 180108* will be collected at least once a week between 8:00 and 14:00 hours;2.3. waste code 180109 will be collected sporadically, on a specific day indicated by the Ordering Party after consultation with the Contractor.The Ordering Party reserves the right to change the dates of waste collection depending on the current needs of the Ordering Party.3.1..2 Based on the provisions of the Act on Waste (Journal of Laws 2019, item 701 as amended), the Ordering Party: a) requires that infectious medical waste with codes 18 01 02* and 18 01 03*, 18 01 06*, 18 01 08* and 18 01 09 - be neutralized by thermal processing in hazardous waste incineration plants; b) provision of the service of thermal processing in hazardous waste incineration plants is carried out in accordance with the so-called "thermal processing". b) the provision of the service of thermal treatment in hazardous waste incineration plants was carried out in accordance with the so-called proximity principle, i.e. in a plant located in the area of the Lower Silesian Province; c) it allows for the disposal of infectious medical waste in the area of a Province other than the Lower Silesian Province, in the closest installation, only if there is no such installation in the area of the Lower Silesian Province or if the existing installations have no free capacity.3The Contractor is obliged to weigh the waste in the presence of the Ordering Party's representative by means of its own legalised scale for weighing the waste at the Ordering Party's seat.3.4 The Ordering Party as the producer of the waste (waste holder) and the Contractor as the transporter and take-over of the waste are obliged to have an entry in the BDO register (BDO registration number) and direct participation in the electronic register of this waste, according to the BDO requirements.3Pursuant to art. 29 par. 3a) of the PPL, the Contracting Authority shall oblige the Economic Operator whose tender will be selected as the most advantageous one - to prove that the person(s) directly performing the service will have employment under an employment contract, within the meaning of art. 22 § 1 of the Act of 26 June 1974. - Labour Code (Journal of Laws of 2019, item 1040 as amended). The employment obligation applies to employees who will perform waste transport (code of profession and specialty: 833203- truck driver with classification - transport of medical waste; with rights defined by ADR convention i.e. international regulations used in transport of dangerous goods). Detailed requirements in this respect have been specified in the draft agreement.4 The conditions for the performance of the contract have also been specified in the draft agreement in Chapter XVII of the ToR.
