The subject of the contract has been described in details in Attachment No. 1 to SWZ (OPZ). c.d. from point VI.4.3)1.2.4 certificate or other document issued by a competent field organizational unit of the Social Insurance Institution (ZUS) or a competent regional branch or a competent field unit of the Agricultural Social Insurance Fund confirming that the Economic Operator is not in arrears with payment of social and health insurance premiums within the scope of art. 109 par. 1 point 1 of the Act, issued not earlier than 3 months before submitting the document, and in the case of arrears in payment of social and health insurance premiums together with a certificate or other document, the Contracting Authority demands submission of documents confirming that respectively before the deadline for submitting requests to participate in the procedure or before the deadline for submitting tenders the Economic Operator made payments of due social and health insurance premiums with interest or fines or concluded a binding agreement on payment of such dues;1.2.5 an extract or information from the National Court Register or from CEiIDG, within the scope of art. 109 par. 1 item 4 of the act, made not earlier than 3 months before submission, if separate regulations require an entry into the register or register;1.2.6 statement of the Economic Operator confirming that the information contained in the declaration referred to in art. 125 par. 1 of the Act is up-to-date, regarding the grounds for exclusion from the procedure indicated by the Contracting Authority, referred to in a) Art. 108 par. 1 item 3 of the Act,b) Art. 108 par. 1 item 4 of the Act, concerning a ban on participation in a public procurement procedure as a preventive measure,c) Art. 108 par. 1 item 5 of the Act, concerning the conclusion of an agreement with other contractors aimed at distorting competition,d) Art. 108 par. 1 item 6 of the Act 1 item 1 of the Act, concerning violation of obligations relating to the payment of taxes and local fees referred to in the Act of 12.01.1991 on taxes and local fees (Journal of Laws of 2019, item 1170),f) Art. 109 par. 1 point 2 letter c of the Act,h) art. 109 par. 1 point 3 of the Act, concerning a punishment for an offense for which a penalty of restriction of freedom or a fine has been imposed,i) art. 109 par. 1 points 5-10 of the Act.The issue of a foreign contractor is specified in Chapter XI par. 2-4 of the SWZ.
