Description

The subject matter of the contract is the service of manufacturing (preparation) of all-day meals for patients of the Municipal Teaching Hospital in Olsztyn, including their delivery to the Ordering Party's seat, according to the principles defined in these Terms of Reference. A detailed description of the subject matter of the contract is contained in Annex 1 to the SWZ (Terms of Reference).
The subject of the contract is the service of manufacturing (preparation) of all-day meals for patients of the Municipal Teaching Hospital in Olsztyn, including their delivery to the headquarters of the Employer in accordance with the principles set out in these Terms of Reference. A detailed description of the subject matter of the contract is contained in appendix no. 1 to the SWZ. 1) In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119 of 04.05.2016, p. 1), hereinafter "RODO", the Contracting Authority informs that: a) the controller of your personal data is Miejski Szpital Zespolony w Olsztynie, ul. Niepodległości 44, 10-045 Olsztyn b) the personal data protection inspector at Miejski Szpital Zespolony w Olsztynie, ul. Niepodległości 44, 10-045 Olsztyn, is Ms Maria Kowalik-Sobczak, contact: e-mail: iodo@szpital.olsztyn.pl ; 608 385 415; c) personal data will be processed on the basis of Article 6(1)(c) and (d) of the RODO for the purpose related to the proceedings in question;d) recipients of personal data will be persons or entities to whom documentation of the proceedings will be made available on the basis of Article 18(1) and Article 74 of the Act of 11 September 2019. - Public Procurement Law (Journal of Laws of 2019, item 2019), hereinafter referred to as the "PPL Act";e) personal data will be kept, pursuant to Article 78(1) of the PPL Act, for a period of 4 years after the end of the procurement proceedings. (f) the contracting authority does not plan to process the contractor's personal data for any purpose other than those related to the proceedings in question. If the controller plans to process personal data for purposes other than those referred to above, before any further processing the controller shall inform the data subject and provide him with the information referred to in Article 13(2) of RODO.2) The contractor is obliged, in connection with his participation in the subject procedure, to fulfil all the formal and legal obligations required by RODO and related to his participation in the subject procurement procedure. These obligations include: a) information obligations pursuant to art. 13 RODO with regard to natural persons whose personal data refer to and from whom the contractor directly obtained such data and transferred them to the awarding entity in the tender or documents submitted upon request of the awarding entity; b) information obligations pursuant to art. 14 RODO with regard to natural persons whose data were obtained by the contractor indirectly and who are transferred by the contractor to the awarding entity in the tender or documents submitted upon request of the awarding entity.3) In order to ensure that the contractor complied with the abovementioned 3) In order to ensure that the Contractor complied with the above mentioned information duties and to protect legitimate interests of a third party, whose data was transferred in connection with participation in the procedure, the Contractor submits a statement in accordance with the content resulting from the Tender Form;4) The obligation to provide personal data is a statutory requirement defined in provisions of the PPL Act, related to participation in the public procurement procedure; consequences of failure to provide certain data result from the PPL Act; see further Chapter XXIV PROVIDENTIAL EVIDENCE The Contracting Authority requires the Economic Operator to submit with the tender the following evidence Certificate, attestation, decision, opinion, confirming that the service will be provided under the HACCP system or equivalent system ensuring food and nutrition safety in the Contractor's kitchen where the services will actually be performed for the Contracting Authority. The Contracting Authority indicates that an equivalent solution may be e.g. ISO 22000, FSSC 22000 if the establishment has certified systems - copy of certificates
