Poland - Mammography equipment

Description

The subject of the contract is the purchase, delivery and installation of a mammograph for the Mazovian Specialist Hospital in Ostroleka within the implementation of the National Oncology Strategy in the scope of the task entitled: "Purchase of diagnostic equipment for early cancer detection - mammographs" of the type and quantity according to Appendix No. 1 to the SWZ (Terms of Reference) and the contract - Assortment and Price Form. A detailed description of the subject of the contract is enclosed as Attachment No. 2 to the SWZ (Terms of Reference) and the contract - List of required and boundary conditions/parameters. This description should be read together with the instruction and training of employees.
As part of the delivery of the equipment mentioned above, the Contractor shall also be obliged to disassemble, install and start up the equipment in the premises indicated by the Ordering Party. The commissioning of the equipment will include acceptance testing of the equipment (with the participation of the Purchaser), as well as instruction of persons indicated by the Purchaser in the use of the equipment.The medical equipment which is the subject of the contract must be the equipment approved for marketing and use in the territory of the Republic of Poland, in accordance with generally applicable legal regulations, including in particular the Medical Devices Act of 20 May 2010. (Journal of Laws of 2020, item 186). The medical equipment, which is the subject of the contract, after delivery in accordance with the concluded contract for the award of a public contract should also be ready for use, including the integration of systems, including the purchase of necessary licenses and implementation, without the need for any other purchases by the Purchaser. The equipment must be brand new, undamaged, free of physical and legal defects. Year of production 2021. The equipment must be mutually integrated and prepared for integration with the MSS information system. The contract is carried out in the framework of the implementation of the National Oncology Strategy in the task entitled: "Purchase of diagnostic equipment for early detection of cancer - mammography". The contracting authority has not divided the contract into parts, because such division in this proceeding is unjustified. In addition, Art. 91 of the Public Procurement Law does not impose an absolute obligation to divide a contract into parts, but it does provide the Contracting Authority with the right to do so.
