Description

The purpose of the contract is the management service of the municipal kennel and cattery, located in via Felesino 4, Cella - Reggio Emilia, with consequent activities of care, maintenance and maintenance of the animals housed, administrative activities, promotion of adoption related; the service for the recovery of stray or stray dogs, injured, sick or dead dogs and cats in the municipal territory; the service for the collection, transport and disposal of dead animals at the municipal kennel/cattery and the corpses of dead dogs and cats collected in the municipal territory, in collaboration with the veterinary service present in the municipal structure.
Article 13 of the Treaty on the Functioning of the European Union requires not only the Union but also the Member States to take full account of the welfare requirements of animals as sentient beings in the exercise of their powers. Law No 281 of 14.8.1991, 'Framework Law on stray animals and prevention of stray animals' and Emilia-Romagna Regional Law No 27 of 7.4.2000, "Norme per la tutela e il controllo della popolazione canina e felina", sanction the application of the principle of the protection of pets, the condemnation of acts of cruelty against them, ill-treatment and their abandonment, in order to promote the proper coexistence between man and animal and to protect public health and the environment, recognizing the promotion of the welfare and protection of pets as an overriding public interest of state importance. Pursuant to Article 4(1) of the abovementioned Law No 281/1991, as amended and supplemented, the municipalities must provide for the management of stray animals, in accordance with the criteria laid down by regional law. Emilia-Romagna Regional Law No 27/2000, as amended and supplemented, transposing the abovementioned legislation, has precisely identified the institutional powers of the municipalities to protect and control the dog and feline population in order to prevent straying. In the light of the above, the Municipality of Reggio Emilia is launching a call for tenders for the management of the municipal dog pound and cats, with consequent activities for the care and maintenance of the animals housed, administrative activities, promotion of adoption, and the recovery service for stray or stray dogs, injured, sick or deceased dogs and cats in the municipal territory, the service for the collection, transport and disposal of dead animals at the municipal dog kennel/cattery and the corpses of dead dogs and cats collected in the municipal territory, in collaboration with the Veterinary Service present in the municipal structure. This tender is carried out through an open procedure with the criterion of the most economically advantageous offer with reference to the technical offer, measured on the basis of a fixed price, pursuant to art. 95, paragraphs 2 and 7 of Legislative Decree no. 50/2016 s.m.i. Therefore, the allocation of the score will be made only on the basis of the criteria relating to the technical offer, as it is believed that the services in question should aim at a high level of quality, establishing a fixed amount for the price component, in order to strengthen the impact of the qualitative elements of the offer.
