Description

The subject matter of the contract is the provision by the Economic Operator to the Contracting Authority of a comprehensive supply of gas fuel in the form of high-methane natural gas (group E), consisting in the sale of gas fuel and provision of distribution services, to installations located in the Contracting Authority's facilities, hereinafter referred to as "Offtake Places", the list of which is included in Appendix No. 2 to the ToR. The ToR is published on the Ordering Party's website www.strzyzowski/bip.2. The total quantity of gaseous fuel that will be delivered during the term of the Agreement to the Take-Off Places specified in Annex 2 to the ToR is estimated at 48,787,500 kWh.3. The Contracting Authority reserves the right to reduce or increase the total volume of gas fuel, in relation to the quantity specified in item 2. During the term of the contract, the Contractor shall supply gas fuel in the quantity corresponding to the actual demand of the Contracting Authority, regardless of the estimated forecast of its consumption. The Contractor shall not be entitled to any claim on account of the Ordering Party's failure to take up the expected amount of gas fuel. Any change in the estimated consumption as specified in item 2 will not result in additional costs for the Ordering Party, except for the settlement of the actual quantity of gas fuel used.4 The order for gas fuel in individual gas months and the order for contractual capacity is specified in Appendix No. 2 to the ToR.5. - Energy Law (consolidated text: Journal of Laws of 2019, item 755) and in accordance with the Executive Regulations issued to this Act.6 The service of gas fuel distribution to the off-take points will be provided through the distribution network owned by the local DSO - Polska Spółka Gazownictwa Sp. z o.o. with its registered office in Warsaw.7The Contracting Authority will grant the Contractor selected in the proceedings a power of attorney to: 7.1. terminate the existing comprehensive gas fuel supply agreements, or to submit a declaration on the termination of comprehensive gas fuel supply agreements by mutual agreement between the Parties,7.2. submit on behalf of the Contracting Authority a comprehensive gas fuel supply agreement to the Distribution System Operator in order to perform the concluded comprehensive gas fuel supply agreement,7.3. perform all actions and arrangements with the DSO and the existing supplier necessary to conduct the procedure of changing the supplier and effectively commence the comprehensive gas fuel supply.8The quality standards referred to in Article 91 paragraph 2a:8.1. in accordance with the Regulation of the Minister of Energy of 24.9.2018. (Journal of Laws of 2018, item 1814) amending the Regulation on detailed conditions for the operation of the gas system. Quality standards are defined in particular in Chapter 8 of the Regulation: "8.2. discounts for failure to meet customer service quality standards and discounts for failure to meet gas fuel quality parameters, in accordance with the DSO Tariff of Polska Spółka Gazownictwa Sp. z o.o. (DSO Polska Spółka Gazownictwa Sp. z o.o.). z o.o. with its registered office in Warsaw, approved by the President of the Energy Regulatory Office on 25.1.2019 with the decision no. DRG.DRG-2.4212.50.2018.AIK;8.3. discounts for failure to meet the quality standards of customer service in accordance with the Contractor's Tariff.
